Maintenance of Seniority. During unpaid leave, an eligible regular employee shall maintain accrued leave, but shall not accrue any additional leave, consistent with Article 14.1, nor accrue seniority (while on unpaid leave of thirty (30) continuous days or more), consistent with Article 7.
1. The Employer shall adjust the employee’s anniversary date to reflect any period of unpaid leave of thirty (30) continuous days or more. Seniority shall continue to accrue and the employee’s anniversary date shall not be adjusted for periods of legally protected leave, such as FMLA or military leave.
Maintenance of Seniority. Seniority shall be maintained, but shall not accrue, during:
a) Periods of unpaid leaves of absence over six months
b) Periods on the re-employment list due to a return from prolonged illness up to 3 years
c) Appointment to an out-of-scope position subject to Article 8.8
d) Lay-off over three months to a maximum of 24 months
Maintenance of Seniority. An employee granted leave under this Article 20.03 shall maintain seniority in the bargaining unit, but shall have no right to displace employees upon return. However, such an employee shall within the limits of the period of time allowed by this article, have the right to apply for vacant positions within her qualifications. In the event of a vacancy in a position which appears to be within the qualifications, skills and abilities of an employee returning from public duty leave, such vacant position need not be posted until a decision with respect to the suitability of the employee is reached.
Maintenance of Seniority. (a) An employee on any authorized leave under the Collective Agreement will maintain his/her seniority date.
(b) An employee laid off and placed on the recall list under Article 12, will retain his/her seniority during the period of xxxxxx.
(c) An employee accepting an assignment within the Fort St. Xxxx Xxxxxx Library Association in a position outside the bargaining unit shall retain his/her seniority date for the period of probation in the excluded position. An employee so assigned may return to a position in the bargaining unit commensurate with their seniority and qualification providing that it is done in the probationary period.
Maintenance of Seniority. (a) An employee on any authorized leave under the Collective Agreement, including annual vacation, will maintain her seniority date.
(b) An employee laid off and placed on the recall list under Clause 12.6 will retain her seniority date during the period of layoff.
(c) An employee accepting a promotion within Interior Savings Credit Union in a management function outside the bargaining unit shall retain her seniority date for a period of six calendar months. An employee so promoted may return to a position in the bargaining unit commensurate with their seniority and qualifications providing that it is done in the six-month period.
(d) Notwithstanding Clause 10.2(c) above, where the six-month training period of the employee so promoted is interrupted by an approved leave of absence from the workplace, the period of retention of seniority and return to a position in the bargaining unit commensurate with her qualifications may be extended by mutual agreement of the parties. Such agreement shall not be unreasonably withheld.
(e) An employee accepting a promotion to a management position excluded from the bargaining unit shall not continue performing bargaining unit duties except in situations and circumstances described in Clause 2.4.
Maintenance of Seniority. Subject to Article 9.02 and Article 9.04 of this Agreement, an employee who maintains employment with the Employer shall maintain accumulated seniority.
Maintenance of Seniority. Seniority shall be maintained, but not accrue, during:
(a) period of lay-off in excess of one month;
(b) suspension for discipline;
(c) unpaid leaves of absence over one hundred and sixty-eight (168) work hours in a calendar year;
(d) the probationary period in a permanent out-of-scope position.
(e) temporary positions in other bargaining units with the Employer not to exceed twelve (12) months unless extended by mutual agreement with the union.
(f) Employees shall have the ability to transfer seniority in accordance with Article 28 PORTABILITY OF BENEFITS AND SENIORITY.
Maintenance of Seniority. Subject to Article 10.02 - Accumulation of Seniority and Article 10.04 - Loss of Seniority of this Agreement, an employee with the Saskatchewan Cancer Agency shall maintain accumulated seniority.
Maintenance of Seniority. (A) Seniority shall continue to be accrued during the first (1st) month of leave of absence without pay and thereafter shall be maintained but not accrued (except as provided in Article 7.02).
(B) Seniority shall continue to be accrued during the first month of layoff, and thereafter shall be maintained, but not accrued, for a period of up to one (1) year.
(C) Seniority for Winter Sessional employees shall be maintained but not accrued during the Inter/Summer Session. Seniority for Inter/Summer Sessional employees shall be maintained but not accrued during the Winter Session.
