Maternity leave notice requirement. 11.3.1 The employee must provide notice to the employer in advance of the expected date of commencement of parental leave. The notice requirements are: a) of the expected date of confinement (including a certificate from a registered medical practitioner stating that the employee is pregnant) - at least ten weeks prior; b) of the date on which the employee proposes to commence maternity leave and the period of leave to be taken - at least four weeks prior. 11.3.2 When the employee gives notice under 11.2.1 (a) the employee must also provide a statutory declaration stating particulars of any period of paternity leave sought or taken by her spouse and that for the period of maternity leave she will not engage in any conduct inconsistent with her contract of employment. 11.3.3 The employee will not be in breach of this clause if failure to give the stipulated notice is occasioned by confinement occurring earlier that the presumed date.
