Payment of Annual Leave on Termination. If, when the employment of an employee ends, the employee has a period of untaken paid annual leave, the employer must pay the employee the amount that would have been payable to the employee had the employee taken that period of leave.

Payment of Annual Leave on Termination. When the employment of an employee terminates, they shall be paid any accrued Annual Leave not taken on the basis of: 39.8.1 Payment for leave entitlements accrued from previous anniversary years based upon ordinary time earnings, plus 17.5% leave loading. 39.8.2 Payment for pro rata leave entitlements accrued from the last anniversary date, calculated on the basis of 1/12th of the ordinary time earnings for that period, excluding 17.5% leave loading. 39.8.3 Where an employee has been granted leave in advance of any entitlement and subsequently terminates their employment prior to accruing the appropriate leave, Myer may deduct monies equivalent to such leave from any payment made to the employee on termination.
