Mechanical Royalties. When a copy of a master recording like the New Recording is sold (either on a CD, or when someone buys it on a service like iTunes) or streamed (e.g., on a service like Apple Music or Spotify), copyright law requires that the songwriters get paid a royalty called a mechanical license. You agree to make sure that Producer is paid mechanical royalties for Producer’s 50% songwriting share of the New Composition, at the minimum statutory rate.
Mechanical Royalties. The Licensee is entitled to keep One Hundred (100%) of all royalties that are generated from record sales of the Master Recording on digital retailers (such as iTunes), through physical sales (such as Compact Disks), and on online streaming services (such as Spotify, Tidal, etc.) **The Licensee is required to contact D Dilla Productions Inc. for a license upgrade once the record sales or streaming limit is reached.
Mechanical Royalties. The royalty paid to Artist after recoupment shall be inclusive of any mechanical royalties and any other fees to which artist may be entitled. Royalties earned by the Artist via traditional compact disc sales or via Digital Download will be "all in" and will include any mechanical royalties. The royalty scale covered in Clauses Six and Seven of this Agreement shall be deemed to have satisfied any mechanical license fee obligations.
Mechanical Royalties. (a) IFP shall be responsible for using best efforts to understand the relevant royalty laws and negotiating favourable Mechanical Royalties on behalf of the Airline. The current agreement is *** of the cost related to music production (Management Fee and Programming Cost), CD Duplication and Encoding.
(b) Mechanical Royalties will be charged to the Airline at cost with no mxxx up.
Mechanical Royalties. (i) The Controlled Rate with respect to Controlled Compositions will be the rate equal to seventy five percent (75%) of the U.S. Minimum Statutory Rate at the time of the Delivery of the Master concerned (but in no event later than the last date for timely Delivery of such Master).
(ii) Notwithstanding anything to the contrary contained herein or in Annex “A” attached hereto, the total Mechanical Royalty for all Compositions (including Controlled Compositions) with respect to each Album (other than Multiple Record Albums) will be not more than ten (10) times the Controlled Rate.
Mechanical Royalties. Client hereby acknowledges that in the United States mechanical royalties for digital sales may be paid by music services/retailers: (i) directly to the music publishers/writers, or (ii) an all-in payment to Symphonic, which includes any fees due to Symphonic. When Symphonic receives what is considered the mechanical royalty as part of the fee due from Partners or others, Symphonic shall identify in the relevant Statement(s) the amount of the payment that comprises the mechanical royalty. This royalty is then paid to Client after all fees expensed by Symphonic.
Mechanical Royalties. Artist acknowledges and agrees that Company will pay a royalty for the mechanical license on all Records manufactured for sale or commercial distribution at % of the minimum compulsory license rate (the "Company Mechanical Rate") applicable in the country of manufacture. The applicable minimum statutory rate shall be determined as of the date of the commencement of the recording of the applicable Master Recording. Mechanical Royalties shall not be payable with respect to musical compositions of one minute or less in duration.
Mechanical Royalties. For compositions written or controlled by KIDNEY THIEVES, PUSH will pay seventy-five (75%) of the U.S. minimum statutory rate in the U.S. at the time of release on record royalty bearing net sales not to exceed eleven (11) times the U.S. minimum statutory rate for LP's, five (5) times for Eps, three (3) times for 12" singles and two (2) times for 7" singles. For USNRC Net Sales in excess of Five Hundred Thousand (500,000) units RECORD COMPANY will pay eighty-seven and one half percent (87-1/2%) of the U.S. minimum statutory rate. For USNRC Net Sales in excess of One Million (1,000,000) units RECORD COMPANY will pay ninety-two and one half percent (92-1/2%) of the U.S. minimum statutory rate. For USNRC Net Sales in excess of One Million Five Hundred Thousand (1,500,000) units RECORD COMPANY will pay one hundred percent (100%) of the U.S. minimum statutory rate. In the event that any single, maxi-single, EP or LP contains other Compositions in addition to Controlled Compositions and the aggregate mechanical royalty rate for said single, maxi-single, EP or LP exceeds the applicable maximum aggregate mechanical royalty rate provided above for Controlled Compositions, the aggregate mechanical royalty rate for the Controlled Compositions contained thereon shall be reduced by the aforesaid excess over said applicable rate. Additionally, Company shall have the right with respect to any single, maxi-single, EP or LP, the aggregate mechanical royalty rate for which exceeds the applicable maximum aggregate mechanical royalty rate provided above for Controlled Compositions, to deduct the excess payable thereon from all royalties payable to you solely pursuant to this agreement. Mechanical royalty payments on Records subsequently returned are considered overpayments.
Mechanical Royalties. The Publisher shall account to the Artist / Composer (UK and International Clients) monthly in the form of an itemised royalty statement within thirty (30) days of the first of the month for all sums received to the Artists / Composers account with the Publisher, except for where the Publisher has previously undertaken to pay any due Mechanical Invoices on behalf of the Artist / Composer. The Publisher will forward any payment due to the Artist / Composer with such statement. The Artist / Composer will not receive a payment or a statement when no royalties have been collected or if they do not exceed £10.00 for UK Clients or £50.00 for International Clients (who do not use PayPal), in which case all due royalties will be held over until they achieve this minimum amount. The minimum accountable value is one xxxxx. Payment will be made by either Internet Bank Transfer, Wire Transfer or PayPal (recommended), as requested by the Artist / Composer, with all attendant charges payable by the Artist / Composer. In the event that an Artist / Composer based in the UK has released, or goes on to release, any physical copies of their music through their own label and this has then become subject to an MCPS AP2 Manufacturing Invoice (even ones the MCPS may grant retrospectively), then we will undertake to pay any such Invoice in full (for all titles that the Publisher administers). (By doing so, this will automatically extend the period of Contracture by an additional 24 months and negate the Artist / Composer's own share in future Mechanical Income). If this service is extended to an Indie Label then, similarly, The Publisher would retain all subsequent amounts received back from the MCPS (nett of MCPS Commissions).
Mechanical Royalties. (50%) minimum statutory rate prevailing at the date of respective albums initial release, 11 cap for albums. 2 Outside compositions @ full statutory rate for samples 87 1/2% of statutory rate @ USNRC 500M prospectively 100% of statutory rate @ USNRC 1MM prospectively.
