Medical Literature Sample Clauses

Medical Literature. Subject to the terms of this Agreement and Applicable Law, CMS shall actively screen relevant scientific and medical literature in the Territory as to the safety of the Product or any information that could constitute a Reportable Event or Product Quality Complaint hereunder. If CMS concludes, using its best professional judgment, that the literature or information constitutes a Reportable Event, it shall forward to Gelesis such literature or information within the timeframe established at Section 4.02(a). If CMS concludes, using its best professional judgment, that the literature or information constitutes a Product Quality Compliant, it shall comply with the investigation, reporting, and submission requirements at Section 5.01. If the information or literature does not constitute a Reportable Event or Product Quality Complaint hereunder, CMS shall provide such information or literature to Gelesis on a weekly basis. Notwithstanding the foregoing, CMS’s requirements under this Section 5.04 shall not limit the responsibility of CMS to report to Gelesis any Reportable Events, in accordance with the content requirements and timeframes stipulated at Section 4.02. If Applicable Law in the Territory requires the reporting of MDRs from scientific and medical literature, the Parties shall comply with the provisions of Section 4.02 and Section 4.03 hereof as to any such submission. For the avoidance of doubt, Gelesis’ or its agent’s literature screening activities do not replace or supplant CMS’s responsibilities under this Section 5.04.

  • Medical Information Throughout the Pupil's time as a member of the School, the School Medical Officer shall have the right to disclose confidential information about the Pupil if it is considered to be in the Pupil's own interests or necessary for the protection of other members of the School community.
