MEMBERSHIP OR SERVICE FEE REQUIREMENT. The parties recognize that Public Act 349 of 2012, which became effective March 28, 2013, contains a provision which states, in part: “…an individual shall not be required as a condition of obtaining or continuing public employment to do any of the following: Become or remain a member of a labor organization or bargaining representative.” The parties to this Agreement will abide by the above law as long as it is in effect. No employee/member shall be required, as a condition of continuing employment, to remain or become a member of OPEIU Local 512. Should the law be changed, repealed or otherwise amended so that membership in a labor organization may once again become a condition of employment; then, the applicable provisions contained in the 2012 Agreement shall be reinstated.

MEMBERSHIP OR SERVICE FEE REQUIREMENT. An employee who is not a member of the Union in good standing or who does not make application for membership within ten (10) working days after completion of forty-five (45) work days of his/her employment shall, as a condition of employment, pay as a service fee to the Union an amount equivalent to the dues uniformly required to be paid by members of the Union (less amounts not permitted by law); provided, however, that the employee may authorize payroll deduction for such fee in the same manner as provided herein. The Union shall be responsible for maintaining a due process procedure for nonmembers to determine how their fee is calculated and utilized and to provide the nonmember an expeditious and impartial hearing regarding their objection.

  • Ongoing Trunk Forecast Requirements Where the Parties have already established interconnection in a LATA, Onvoy shall provide a new or revised traffic forecast that complies with the Frontier Interconnection Trunking Forecast Guide when Xxxxx develops plans or becomes aware of information that will materially affect the Parties’ interconnection in that LATA. Instances that require a new or revised forecast include, but are not limited to: (a) Onvoy plans to deploy a new switch; (b) Onvoy plans to implement a new POI or network architecture; (c) Onvoy plans to rearrange its network; (d) Onvoy plans to convert a One-Way Interconnection Trunk group to a Two-Way Interconnection Trunk group; (e) Onvoy plans to convert a Two-Way Interconnection Trunk group to a One-Way Interconnection Trunk group; or (f) Onvoy expects a significant change in interconnection traffic volume. In addition, upon request by either Party, the Parties shall meet to: (i) review traffic and usage data on End Office and Tandem Interconnection Trunk groups and (ii) determine whether the Parties should establish new Interconnection Trunk groups, augment existing Interconnection Trunk groups, or disconnect existing Interconnection Trunks.

  • EDD Independent Subrecipient Reporting Requirements Effective January 1, 2001, the County of Orange is required to file in accordance with subdivision (a) of Section 6041A of the Internal Revenue Code for services received from a “service provider” to whom the County pays $600 or more or with whom the County enters into a contract for $600 or more within a single calendar year. The purpose of this reporting requirement is to increase child support collection by helping to locate parents who are delinquent in their child support obligations. The term “service provider” is defined in California Unemployment Insurance Code Section 1088.8, Subparagraph B.2 as “an individual who is not an employee of the service recipient for California purposes and who received compensation or executes a contract for services performed for that service recipient within or without the State.” The term is further defined by the California Employment Development Department to refer specifically to independent Subrecipients. An independent Subrecipient is defined as “an individual who is not an employee of the ... government entity for California purposes and who receives compensation or executes a contract for services performed for that ... government entity either in or outside of California.” The reporting requirement does not apply to corporations, general partnerships, limited liability partnerships, and limited liability companies. This initial traffic forecast will provide the amount of traffic to be delivered to and from Verizon over each of the Interconnection Trunk groups in the LATA over the next eight (8) quarters.
