Method of Making Collections. The Recovered Materials Dealer agrees to collect and transport materials in a manner and method acceptable to the City. The Recovered Materials Dealer agrees to take care in the loading and transportation of materials so that none of the material to be collected is left on public property or on City streets or alleys. Any materials left on public property or on City streets or alleys by the Recovered Materials Dealer shall be cleaned up immediately by the Recovered Materials Dealer or its designee. If the Recovered Materials Dealer fails to clean up the same within three (3) business hours after notice from the City, the City may cause such public property, streets, or alleys to be cleaned and may charge all costs to the Recovered Materials Dealer, plus an administrative overhead fee of 50% of such costs. The Private Collector agrees to take care in the loading and transportation of garbage and other solid waste refuse so that none of the material to be collected is left on public property or on City streets or alleys. Any garbage or other refuse left on public property or on City streets or alleys by the Private Collector shall be cleaned up immediately by the Private Collector or its designee. If the Private Collector fails to clean up the same within three (3) business hours after notice from the City, the City may cause such public property, streets, or alleys to be cleaned and may charge all costs to the Private Collector, plus an administrative overhead fee of 50% of the costs. In addition, the Private Collector agrees, pursuant to City Code, that:
Method of Making Collections. The Franchisee shall collect and transport Commercial Solid Waste in compliance with the requirements in this Agreement and the Ordinance. The Franchisee shall take care in the loading and transportation of Commercial Solid Waste so that none of the solid waste is left on public or private property in the City. Any solid waste, litter, or liquid spilled, discarded, or otherwise left on public or private property by the Franchisee shall be cleaned up immediately by the Franchisee. If the Franchisee fails to clean up the same within two (2) hours after notification by the City, the City may cause such property to be cleaned and then the City may charge all associated costs to the Franchisee, plus a ten percent (10%) administrative overhead fee.
