Minimum Rest Periods. (a) A non-shift employee who works any overtime between 11:00 p.m. and 6:00 a.m. will be entitled to one hour of paid rest time for each hour worked (including travel time as described in 7.9(b) above) during this seven-hour period, starting at the beginning of the employee’s regular shift that day. If the employee and supervisor agree, the employee may begin the regular shift and take the rest time on the same hour-for-hour basis at the end of the shift, or if that is not possible, at the beginning of the next shift, if the next shift occurs on the next calendar day. If the employee is required to work through the employee’s regular shift and there is no agreement to take rest time at the beginning of the next shift, the employee will be paid time-and-a-half during the period the employee is working that should have been rest time. If the employee is not scheduled to work a regular shift on the day the rest time is incurred, the employee shall not receive rest time. (b) An employee who has worked continuously fourteen (14) hours or more shall be entitled at the end of the work assignment to eight (8) continuous hours of rest (exclusive of travel time and established lunch period), before reassignment or reporting for the normally scheduled work day or reassignment. If such rest period should overlap the employee's normal workday, he/she shall suffer no loss in pay for the time of such overlap` (c) If an employee is required to return to work before the appropriate minimum rest period has elapsed, he/she shall be paid at the prevailing rate until the full continuous rest period has been granted. (d) If employees must be called into work, an employee who is on a rest period will be the last one called in. (e) Management generally will attempt to ensure that employees receive their full rest time as soon as possible following the overnight call-in, as the goal is to ensure that employees have at least six hours of rest before starting their regular shift.

Minimum Rest Periods. 9.4.1 Equal time off (arest period) A non-shift for work between 10:00 p.m. and 6:00 a.m. Any employee who works any overtime between 11:00 10:00 p.m. and 6:00 a.m. will be entitled to one hour an aggregate of paid rest time for each hour worked (including travel time as described in 7.9(b) above) during this seven-hour period, starting at the beginning of the employee’s regular shift that day. 9.4.2 For work extending into next regular shift, employee would receive equal rest time taken immediately following the completion of the work that caused the need for rest time or, with the approval of the employee’s supervisor, at the end of that day’s work.
9.4.3 If equal time off results in less than two (c2) hours remaining in regular shift, then employee will not be required to report for work with no loss of pay.
9.4.4 If an employee is required required, by mutual consent, to return to work before the appropriate minimum rest period has elapsed, he/she shall be paid at the prevailing overtime rate for hours worked until the full continuous rest period has been granted.
(d) If employees must be called into work, an employee who is on a granted or received. The rest period will be unpaid, except for rest period hours that coincide with the last one called inemployee’s regularly scheduled hours of work, during which time the employee is entitled to straight time pay.
9.4.5 An employee, who has worked continuously 16 hours or more, will be entitled at end of work assignment to eight (e) Management generally will attempt to ensure that employees receive their full rest time as soon as possible following the overnight call-in, as the goal is to ensure that employees have at least six 8) hours continuous hours of rest before starting their regular shiftreporting for the normally scheduled work day. He/she shall be paid at the overtime rate for hours worked until the full continuous rest period has been granted or received. The rest period will be unpaid, except for rest period hours that coincide with the employee’s regularly scheduled hours of work, during which time the employee is entitled to straight time pay.
