Meal Breaks and Rest Periods. For each seven and one-half (7 ½) hour shift, subject to the provisions of Article 14.09, the Employer shall provide an unpaid meal break of one-half (½) hour and paid rest periods totalling one-half (½) hour, not to be taken in less than two (2) breaks. The Employer shall schedule meal breaks in such a way that an employee be permitted to leave her work area. Operational requirements may be such that these breaks may not be able to be taken off the premises. These breaks shall be prorated for shift duration.

On completion of not less than three hours work after commencement time or on completion of not less than two hours work after the meal break weekly Employees will become entitled to a rest period of ten minutes duration. Such rest period for pay purposes will be treated as time worked.

7.4 Rest breaks of 10 minutes each for morning tea, afternoon tea or supper, and the equivalent breaks for night duty where these occur during duty, shall be recognised as time worked.
7.5 During the meal break or rest breaks prescribed above, free tea, coffee, milk and sugar shall be supplied by the employer. Where it is impractical to supply tea, coffee, milk and sugar free of charge, an allowance of $1.46 per week in lieu shall be paid. This allowance shall continue during all periods of leave except leave without pay.

8.2 Employees who work for two hours or more are entitled to a paid 10 minute rest break.
8.3 Employees who work for four hours or more are additionally entitled to an unpaid meal break.
8.4 Employees who work six hours or more in a day are entitled, within each working day, to two paid ten-minute rest breaks and an unpaid meal period of at least half an hour.
8.5 An employee who is unable to be relieved from work for a meal break shall be entitled to have a meal while on duty and this period shall be regarded as working time. The employee shall comply with the employer’s policy as to where on the premises the meal may be taken.
8.6 During the meal break or rest breaks specified above, free tea, coffee, milk and sugar shall be supplied by the employer when the break is taken on the premises. This shall not apply when employees are working off site.
8.7 The employer shall ensure so far as practicable, given the employers operational requirements and resources, that appropriate facilities are to be provided in the workplace for an employee who wishes to breastfeed and that appropriate breaks are provided for this. Such breaks shall be unpaid unless otherwise agreed.

10.3 Except where provided for in 10.2 above an employee unable to take a meal after five hours, half-ordinary time shall be paid as a penalty payment from the expiry of five hours until the time of taking the meal break.
10.4 Rest breaks of 10 minutes each for morning tea, afternoon tea or supper, and the equivalent breaks for night duty where these occur during duty, shall be recognised as time worked.
10.5 During the meal break or rest breaks prescribed above, free tea, coffee, milk and sugar shall be supplied by the employer. Where it is impractical to supply tea, coffee, milk and sugar free of charge, an allowance of $5.00 per week in lieu shall be paid. This allowance shall continue during all periods of leave except leave without pay.

There will be only one meal break of not less than half an hour during a 10-hour shift.
b. In addition, an employee who works 12-hour shift shall be allowed two meal breaks, one paid and one unpaid, each of not less than half an hour. The second meal break is to be taken after having worked eight hours of the shift. Such meal breaks shall be arranged so as to be spaced as near as possible at equal intervals.
c. A midwife unable to be relieved from the workplace for a meal break shall be allowed to have a meal while on duty and this period shall be regarded as working time.
d. Except where provided for in (c) above, a midwife unable to take a meal after five hours’ duty shall from the expiry of five hours until the time when a meal can be taken, be paid T0.5 in addition to the hourly rate that would otherwise be payable.
e. Rest breaks of 10 minutes each for morning tea, afternoon tea or supper (and the equivalent breaks for night shift), where these occur during duty, shall be allowed as time worked.
f. During the meal break or rest breaks prescribed above, free tea, coffee, milk and sugar shall be supplied by the employer. Where it is impractical to supply tea, coffee, milk and sugar free of charge, an allowance of $1.46 per week in lieu shall be paid. This allowance shall continue during all periods of leave except leave without pay.
Meal Breaks and Rest Periods a) The employer undertakes to stress to operational managers the need for staff to be able to take an adequate meal break during their working day, and their responsibility to ensure that this happens to the best of their ability.
b) Casual staff are entitled to meal breaks and payments for such breaks as apply equally to permanent staff.
c) Except when required for urgent or emergency work and except as provided in (e) below, no employee shall be required to work for more than five (5) hours continuously without being allowed a meal break of a minimum of half an hour.
d) An employee unable to be relieved from work for a meal break shall be allowed half an hour to have a meal on duty and this period shall be regarded as working time.
e) Except where provided for in (c) above, an employee unable to take a meal after five hours duty shall be paid at time-half rate (T0.5) in addition to normal/ordinary rate of pay from the expiry of five (5) hours until the time when a meal can be taken.
f) Rest breaks of ten (10) minutes each for morning tea, afternoon tea or supper, where these occur during duty, shall be allowed as time worked.
g) During the meal break or rest breaks prescribed above, free tea, coffee, milk and sugar shall be supplied by the employer. Where it is impractical to supply tea, coffee, milk and sugar free of charge, an allowance in lieu shall be paid as follows:
a. Northland - $1.25 per week b. Tairawhiti - $1.31 per week
Meal Breaks and Rest Periods. (a) Employees shall be entitled to fifteen (15) minutes paid rest period within each four (4) hours of work.
(b) Every employee scheduled to work six (6) or more hours shall be entitled to an unpaid meal break of thirty (30) minutes.
