Missing Participants. In the event that MassMutual cannot from its records ascertain the whereabouts of a participant or beneficiary entitled to a distribution from the Plan, MassMutual will notify the Plan Sponsor. The Plan Sponsor is responsible for locating missing participants and directing MassMutual as to the disposition of missing participants’ benefits.
Missing Participants. If a benefit is forfeited because the Participant or Beneficiary cannot be found, such benefit will be reinstated if a claim is made by the Participant or Beneficiary.
Missing Participants. Neither the Trustee nor the Administrator will be required to search for or ascertain the whereabouts of any Participant or Beneficiary. With respect to a Participant or Beneficiary who has not claimed any benefit (the "missing payee") to which such missing payee is entitled, and with respect to any Participant or Beneficiary who has not satisfied the administrative requirements for benefit payment, the following provisions will apply:
Missing Participants. If a distribution is required under the terms of the Plan, the Plan Administrator shall provide the Trustee with the infor- mation necessary to make such distribution, including the last known address of the Participant or Beneficiary.
Missing Participants. The Board of Trustees shall comply with the applicable requirements of a diligent search, transfer of benefits and reinstatement as required pursuant to Title IV of ERISA and the regulations thereunder.
Missing Participants. Upon termination of the Plan, if any Participant cannot be located after a reasonable diligent search, the Plan Administrator may make a direct rollover to an IRA selected by the Plan Administrator. An Automatic Rollover under this subsection (c) may be made on behalf of any missing Participant, regardless of the value of his/her vested Account Balance.
Missing Participants. If the Plan Administrator cannot ascertain the whereabouts of any Participant to whom a payment is due under the Plan, the Plan Administrator may direct that the payment and all remaining payments otherwise due to the Participant be cancelled on the records of the Plan and the amount thereof applied as a forfeiture in accordance with Plan provisions except that, in the event the Participant later notifies the Plan Administrator of his whereabouts and requests the payments due to him under the Plan, the forfeited amount shall be restored either from Trust income or by a special contribution by the Plan Sponsor to the Plan, as determined by the Plan Administrator, in an amount equal to the payment to be paid to the Participants.
Missing Participants. Subject to all applicable laws relating to unclaimed property, if the Plan Administrator mails by registered or certified mail, postage prepaid, to the last known address of a Participant or Beneficiary, a notification that he is entitled to a distribution hereunder, and if the notification is returned by the United States Postal Service as being undeliverable because the addressee cannot be located at the address indicated, and if the Plan Administrator has no knowledge of such Participant's or Beneficiary's whereabouts within three (3) years from the date the notification was mailed, or if within three (3) years from the date the notification was mailed to the Participant or Beneficiary, he does not respond thereto by informing the Plan Administrator of his whereabouts, then, and in either of those events, upon the Valuation Date coincident with or next succeeding the third anniversary of the mailing of the notification, the then undistributed Accrued Benefit shall serve to reduce the Matching Contribution, if any, on that Valuation Date or any subsequent Valuation Date; provided, however, that such amounts shall be reinstated to the proper Participant Accounts upon a valid claim therefor by the proper Participant or Beneficiary.
Missing Participants. In the event that the Committee is unable to locate a Participant or Beneficiary within two years following the date the Participant was to commence receiving payment, the entire amount credited to the Participant’s Defined Contribution Account shall be forfeited. If, after such forfeiture, the Participant or Beneficiary later claims such benefit, such benefit shall be reinstated without interest or earnings from the date payment was to commence pursuant to ARTICLE VII above.
Missing Participants. In the event that all, or any portion, of the distribution payable to a Participant or his beneficiary hereunder shall, at the expiration of five (5) years after it shall become payable, remain unpaid solely by reason of the inability of the Company, after sending a registered letter, return receipt requested, to the last known address, and after further diligent effort, to ascertain the whereabouts of such Participant or his beneficiary, the amount so distributable shall be forfeited and shall be used to reduce the cost of the Plan. In the event a Participant or beneficiary is located after his benefit has been forfeited, such benefit shall be restored. Executed this _____ day of ____________, 1996.
