Monthly Rent PaymentsTenant shall pay, as rent for the Premises, estimated monthly Base Rent in advance, on or before the first (1st) day of each calendar month of the Term, as set forth below: (a) On or before the Rent Commencement Date and the first (1st) day of each calendar month thereafter, Tenant shall pay the current monthly Minimum Annual Guarantee to the City’s Rent Payment Address. (b) On or before the twentieth (20th) day of each calendar month after the First Month, concurrently with its submission of the Sales Reports described below covering the prior calendar month, Tenant shall pay to City the deficiency, if any, between the Base Rent payable by Tenant with respect to such prior calendar month (based on the Gross Revenues achieved with respect to such prior month), and the amount actually paid by Tenant pursuant to the foregoing subsection (a) with respect to such month. (c) All payments hereunder shall be paid to City’s Rent Payment Address, or at such other place as City may from time to time designate in writing. (d) All Rent shall be paid in lawful money of the United States, free from all claims, demands, setoffs, or counterclaims of any kind. (e) Any Rent not paid when due shall be subject to a service charge equal to the lesser of the rate of one and one-half percent (1½%) per month, and the maximum rate permitted by law. Acceptance of any service charge shall not constitute a waiver of Tenant’s default on the overdue amount or prevent City from exercising any of the other rights and remedies available to City.

Without limiting the generality of the foregoing, as the Initial MAG is an annual amount, the Minimum Annual Guarantee with respect to the first Lease Year shall be prorated, based on a 365-day year, to reflect the fact that the first Lease Year shall be less than a full 12-month period. (e) All Rent shall be paid in lawful money of the United States, free from all claims, demands, setoffs, or counterclaims of any kind. (f) Any Rent not paid when due shall be subject to a service charge equal to the lesser of the rate of one and one-half percent (1½%) per month, and the maximum rate permitted by law. Acceptance of any service charge shall not constitute a waiver of Tenant’s default on the overdue amount or prevent City from exercising any of the other rights and remedies available to City.
Monthly Rent Payments. Rent under Sections 4.1(a) and (b) shall be due and payable in twelve (12) equal installments of one-twelfth (1/12) each on the first day of each calendar month during the Lease Term and any extensions or renewals thereof without demand, counterclaim or offset. If the Lease Term commences on a day other than the first day of a calendar month or ends on a day other than the last day of a calendar month, then the Rent under Sections 4.1(a) and (b) for the first and last fractional months shall be appropriately prorated. If the Lease Term commences on a day other than the first day of a calendar year, for purposes of calculating Expense Rent, the Operating Expenses for such year and for the Base Year shall each be reduced by the proportion that the number of days of the Lease Term falling within such calendar year bears to three hundred sixty-five (365) days. Rent under Section 4.1(c) and any other amounts due under this Lease shall be collected pursuant to written notices from Landlord and payment shall be due within fifteen (15) days of such notice.

(b) All payments hereunder shall be paid at the Office of Director, or at such other place as City may from time to time designate in writing. All Rent shall be paid in lawful money of the United States, free from all claims, demands, setoffs, or counterclaims of any kind. Monthly Rent Payments. Lessee’s obligation to pay Base Rent shall commence on the Lease Commencement Date, subject to the rent abatement set forth herein, and shall thereafter be due and payable in advance on the first day of each month during the Lease Term and any extensions or renewals thereof, without demand or prior written notice; provided, however, Lessee shall pay Base Rent for the first month of the Lease Term for which Base Rent shall be due concurrently with Lessee’s execution of this Lease, and such payment of Base Rent shall be credited to Base Rent due and payable for the first month for which Base Rent is payable, provided, however, if said month is a partial calendar month (due to the fact that the Lease Commencement Date is other than the first day of a calendar month) any unapplied Base Rent shall be credited towards Base Rent due for the next following month. In addition, if the Lease Term commences on a day other than the first day of a month or ends on a day other than the last day of a month, then Rent payable under Articles 4.1(a) and (b), as the case may be, for the first and last fractional months shall be appropriately prorated based on a 30 day calendar month.

Monthly Rent PaymentsXxxxxx agrees that the Monthly Rent shall be paid in lawful money of the United States via the Xxxxx Resident App. Xxxxxx agrees that the Monthly Rent will be deemed paid only once Landlord or Xxxxxxxx’s agent receives the Monthly Rent. If there are multiple Tenants signed to this Lease Agreement, all such Tenants are jointly, severally and individually bound by, and liable under, the terms and conditions of this Lease Agreement. A judgment entered against one Tenant shall be no bar to an action against other Tenants. Xxxxxx agrees that If the Monthly Rent is not paid by the end of the fifth (5th) business day following the Payment Date, Tenant shall pay a late charge equal to the greater of (i) fifteen dollars ($15) or (ii) five percent (5%) of the Monthly Rent, as allowed under the applicable North Carolina law. Tenant’s failure to pay any portion of the Monthly Rent or fee or expenses due hereunder, shall constitute a default under this Lease Agreement. In that event, Landlord may, without limiting any of its other rights and remedies, terminate Tenant’s occupancy and commence eviction proceedings, and to take any actions available to Landlord under applicable law. Tenant shall continue to be liable for all portion of the Monthly Rent and all other fees or expenses payable hereunder, as well as any fees or expenses incurred by the Landlord in connection with the collection of any unpaid portion of the Monthly Rent by the Tenant.
Monthly Rent Payments. Tenant agrees to pay rent to Landlord, without demand or any offset or reduction whatever (except as made in accordance with the express provisions of this Lease), equal to the Annual Rent, in equal installments of the Monthly Rent in advance for each calendar month included in the Term (except as provided in the next succeeding sentence hereof); and, for any portion of a calendar month at the beginning or end of the Term, at the proportionate rate payable for such portion. If the Commencement Date is other than the first day of a calendar month, then the payment of Monthly Rent due on the Commencement Date shall be the Monthly Rent allocable to tile period beginning on the Commencement Date and ending on the last day of tile first full calendar month of the Term; and, in such event, Tenaxx'x xext payment on account of Monthly Rent (on account of the second (2nd) full calendar month during the Term) shall be due and payable on the twenty-fifth (25th) day of the first full calendar month of the Term.
