More alternative provision?. From the ABP and school-level interviews and from the school questionnaire, a strong theme for the future was a need for more, and more varied, alternative provision. ‘The appalling lack of facilities for students with sever behavioural issues means that […] schools are left trading highly volatile students in managed moves […]’ (senior leader) The limited options (in some areas, reportedly, no options) at Key Stage 3 (KS3) was a particularly strong issue: ‘The real problem that we have is a lack of high quality KS3 alternative provision […]’ (senior leader) This view was endorsed by a majority of those who responded to the school questionnaire:  all but two (18 of 20) senior leaders who responded to the questionnaire ‘strongly agreed’ (16) or ‘agreed’ that, ‘our ABP needs (more) good, local KS3 alternative provision’. o The two exceptions both ‘strongly disagreed’ and both were from South ABP The need for a wider range of providers on the existing Framework Agreement was also expressed. Among the 20 senior leaders who responded to the school questionnaire:  all but one (19 of 20) ‘strongly agreed’ (14) or ‘agreed’ (5) that, ‘our ABP would benefit from a greater range of local providers than is on the Framework Agreement (e.g. providers of positive male mentors, of a wider range of vocational areas, of specialist tutors for English and Maths)’. In the school-level interviews, more than one wanted the future range of provision to include area-based or even on-site alternative provision that was controlled by ABP headteachers. For example, School 5 stated a desire to create an, ‘on-site unit for students with social, emotional and mental health needs that are not able to manage within the mainstream environment’. As another example, School 6 had an off-site provision but wanted to be able to offer practical, vocational areas such as Motor Vehicle and Hair and Beauty – but also noted a potential down-side of this idea: ‘on the other hand, you don’t want all the high profile young people in one place’. Interviewees in that school argued that what was needed was alternative provision [we paraphrase here] that does the sort of things done by The Prince’s Trust, such as outdoor and life skills and qualifications; also the sort of support around drugs provided by Compass; and the kind of therapeutic support that state boarding schools offer; plus male mentors for boys who’ve drifted into the drug scene (‘they need a father figure’). The Board shall pay the difference between compensation (excluding a travel allowance) for jury duty and the teacher’s salary if such duty is during teacher employment days.

Such right of recapture shall exist for a period of two (2) years following release of any report from an audit conducted by the COUNTY and/or the State Auditor’s Office under the Section 4 (EVALUATION AND MONITORING) provisions or the 3-year records retention period required under Section 4 (EVALUATION AND MONITORING), whichever occurs later. Repayment by the ORGANIZATION of any funds recaptured under this provision shall occur within twenty (20) days of any demand. In the event the COUNTY is required to institute legal proceedings to enforce this recapture provision, the COUNTY shall be entitled to its costs thereof, including reasonable attorney’s fees.

  • CERTAIN TERMINATIONS PROHIBITED; CERTAIN CANCELLATIONS NON-APPEALABLE The following circumstances will not be considered a valid basis for termination of this agreement, and will be considered non- appealable or irrelevant to an appeal of a cancellation fee assessment:
