Other Leave Provisions. 1. The Board shall provide a substitute for those who serve on jury duty, National Guard and Reserve military duty, and who are subpoenaed to participate in court proceedings in which they are not involved as a party litigant or have an interest in the outcome of the proceeding. The Board shall pay the difference between compensation (excluding a travel allowance) for jury duty and the teacher’s salary if such duty is during teacher employment days.
2. A leave of absence without pay of up to two (2) years may be granted to any full-time teacher, upon application and approval, in the sole discretion of the Board, for the purpose of participating in educationally recognized and/or accredited teaching programs in other school districts, states, U.S. territories and domestic military programs as a full-time participant in such a program. Upon return from such a leave, a full-time teacher shall be placed in the same position on the Professional Compensation Schedule as he/she would have been if he/she had worked in the District during the period of such a leave, provided the teaching program has been approved in advance by the Superintendent and the Superintendent determines that the teacher has satisfactorily completed the teaching program in question.
3. A leave of absence without pay of up to one (1) year may be granted to any full-time tenured teacher, upon application and approval, in the sole discretion of the Board, for the purpose of study, travel, or personal business, but it is not the intent that such leave would be approved when it follows parental leave as provided in Section E above. No experience step increase shall be granted on the Professional Compensation Schedule for the period of such leave. Such leave may be extended for up to an additional one (1) year under the same terms and conditions.
Other Leave Provisions. A. Members of the bargaining unit, who do not meet other paid leave provisions, may be granted unpaid leave at the discretion of the Superintendent and/or the Board.
B. Any bargaining unit member on any unpaid leave of absence shall be entitled to participate, at the member’s own expense, in all Board insurance programs at the group rates, provided this is permitted by the insurance carriers involved and provided further that the necessary payment arrangements are made with the Treasurer’s Office.
Other Leave Provisions.
1. All benefits to which a teacher was entitled at the time a leave of absence commenced shall be restored to the teacher upon return, and the teacher will be assigned to the same or an available substantially equivalent position.
2. A teacher on a leave of absence must notify the Superintendent by March 15th, in the year which the teacher’s leave expires, of the teacher’s intent to return the following September.
3. Leaves of absence may be extended by the School Board.
4. Teachers shall be granted the full amount of sick, personal and emergency leaves at the beginning of each year. Teachers shall be required to reimburse the District on a pro-rated basis if the teacher leaves the District prior to working sufficient days to earn any leave taken.
Other Leave Provisions. 1. Where an employee is entitled to receive workers' compensation disability payments under the Workers' Compensation Law for a disability sustained, arising from, or in the course of employment; they shall elect in writing whether they desire to use accrued sick leave during the period of disability in lieu of receiving Workers' Compensation payments. Such written notice shall be filed with the employing Department Head, the Workers' Compensation Committee, and the Human Resources Department.
(a) Upon receipt of a request for reimbursement from the employing Department Head, reimbursement at the established workers' compensation rate in each instance will be made by the Workers' Compensation Department for the period of disability paid and reinstatement of sick time shall be made in accordance with the following formula: Employee's daily rate of pay nearest half day.
2. An employee isolated or quarantined because of exposure to a communicable disease, shall for the purpose of this regulation be considered absent because of sickness and may be granted sick leave with pay during such isolation or quarantine, to the extent of his accumulated and unused sick leave time.
3. It shall be the duty of every Department Head to make a report in writing to the Human Resources Department, setting forth the name of employees, with the sick leave and vacation leave granted during the period covered by this report.
4. A permanent employee may, in the discretion of the Department Head, be granted leave of absence without pay for a period not exceeding one (1) year. An employee may be required to exhaust accrued leave credits, consistent with the allowable use of leave under this contract, prior to the granting of an unpaid leave of absence.
5. On proof of the necessity of jury service or attending court pursuant to subpoena or other order of the court, an employee shall be granted such leave of absence with pay by the Department Head.
6. When an employee is on a leave of absence for three (3) months or longer, the anniversary date for longevity and vacation will be adjusted to reflect the leave of absence. Sick leave credits will be earned when an employee is on full pay status for seven (7) out of ten (10) days in the preceding payroll period. Days during which the employee is using accumulated sick leave credits, including Workers' Compensation, in excess of sixty (60) consecutive calendar days, are not considered to be days on full pay status for purposes of earning si...
Other Leave Provisions. 1. Other leaves, or extensions of leaves, may be granted at the sole discretion of the Employer upon written request by the employee.
2. Upon return from leave, the employee's previously unused accumulated sick leave days shall be restored.
Other Leave Provisions. (a) Employees with at least twelve (12) months of service and who have worked at least 1,250 hours during the twelve (12) month period preceding the start of the leave, are eligible to take up to a maximum of twelve (12) workweeks (i.e., for an employee normally scheduled to work five (5) days per week, sixty (60) days) of their Medical Leave or Special Leave in any twelve (12) month period on an intermittent or reduced leave basis, provided it is certified as medically necessary. If leave is requested on this basis, however, the Board may; at its discretion, require the employee to transfer temporarily to an alternative position which better accommodates the recurring periods of absence or to a part-time schedule, provided that the position has equivalent pay and benefits.
(b) Notwithstanding other provisions of this Article XI, employees can maintain coverage of the group health plan under the conditions coverage would have otherwise been provided if the employee had continued to work, for the first twelve (12) weeks of a Parental, Medical or Special Leave of Absence taken during any twelve (12) month period.
Other Leave Provisions. 1. An employee returning from a medical leave of absence of one (1) year or less shall be returned to the same previously held position. If the position has been eliminated, the employee shall assume the position of the least senior employee in the returning employee's classification with comparable hours, providing the employee has less seniority than the employee returning. If the employee returning from leave does not have sufficient district-wide seniority to obtain a position, he/she shall be placed on layoff status.
2. Upon return from all other leaves of absence, the returning employee shall assume the position of the least senior employee in the returning employee's classification with comparable hours, providing the employee has less seniority than the employee returning. 3. Upon return from leaves, previously earned sick leave and district-wide and classification seniority shall be restored. Seniority (district-wide and classification) shall not accrue while on an unpaid leave of absence, but seniority shall accrue while on a paid leave of absence as cited in Article X of this agreement.
Other Leave Provisions. 1. An employee who meets all of the requirements as herein before specified shall be granted a leave of absence without pay; he/she shall accumulate seniority during such leave of absence, and he/she shall be entitled to resume his/her regular seniority status and all job and recall rights. An employee returning from an unpaid leave of absence of not more than one (1) calendar year shall be entitled to the position held at the time the leave was granted. An employee returning to work from a leave of absence of more than one (1) year as approved by the Board of Education shall be entitled to the position held by the least senior employee within the job classification for which the employee is qualified. Leaves of absence may be granted at the discretion of the Employer for reasons other than those listed above when they are deemed beneficial to the Employer.
Other Leave Provisions. 1. No sick leave for the current year will be paid to a new employee before starting to fulfill the terms of her/his contract.
2. Absences not covered by the sick leave, emergency leave, or personal leave policies will result in a deduction in pay computed on a per diem basis.
3. All accumulated leave time shall terminate upon severance of employment. However, if alleged contract or discipline violations which prompted severance prove to be unwarranted, all accumulated leave due said employee shall be reinstated.
4. The Board will make every effort and strive to maintain a list of substitutes. Employees shall be informed of a telephone number they may call before 7:00 a.m. to report unavailability. It shall be the responsibility of the administration to arrange for a substitute or make other provision before school convenes.
