Common use of Moving Out Clause in Contracts

Moving Out. a. Each Resident must remove all personal belongings from their room when the Occupancy period ends or this Contract is terminated. The room must be cleaned and all keys returned to their respective service center prior to move out being complete. Remaining personal items will be considered abandoned and will be sent to OSU Surplus for public auction or disposal. Failure to vacate by the time and date required (typically 72 hours after given notice by UHDS unless approval has been granted for an extension by the Assistant Director of Occupancy Management) may result in charges calculated to reasonably compensate the University for damage incurred by the delay, in addition to which includes the cancellation fee for the term that just ended (see Section 7 (a) and possibly prorated Room and Dining charges, unless the Resident withdraws from OSU after the times and dates listed in Section 15(e16(e). Residents who do not intend to live on campus have a signed UHDS contract for Winter Term 2016-2017 must vacate by 5:00 PM on December 7September 2, 2018 and Residents who do not intend to live on campus for Spring Term must vacate by 5:00 PM on March 22, 20192016. If a Resident fails to do this, this they are subject to a $250 Extended Occupancy fee. f. Failure to vacate by the time and date required may result in charges calculated to reasonably compensate the University for damage incurred by the delay, in addition to prorated Room and Dining charges, unless the Resident withdraws from OSU after the times and dates listed in Section 15(e6(b). Moving Out. a. Each A. End of Agreement Period: Unless Resident is graduating, Resident must remove check out, return all personal belongings from their room when keys, and leave his/her room, suite or apartment in good order by the Occupancy period ends earlier of (1) twenty-four (24) hours after Resident’s last scheduled final examination of the Spring Semester or this Contract is terminated(2) noon on the day following the last day of exams as published by the Office of the Registrar. The room must be cleaned and all keys returned to their respective service center prior to move out being complete. Remaining personal items All Residential areas will be considered abandoned and closed for all non-graduating students at noon the day following the last day of exams. Graduating Residents may stay until 6:00 PM of the day of Fall or Spring Graduation. If Resident is graduating for Fall or will be sent leaving to OSU Surplus for public auction or disposalparticipate in study abroad, Resident must cancel their Spring housing agreement by December 1st via the Agreement Release Request. Residents It is expected that facilities (bedrooms, bathrooms, sinks, and university owned appliances and furniture, showers) will be left in an acceptable state of cleanliness. The Resident agrees to pay for keys not returned and to cover the cost of extra custodial additional housekeeping service if deemed necessary by HRL. B. Within Agreement period: If Resident withdraws or terminates his/her enrollment during the academic year, or if Resident’s enrollment is terminated by the University, Resident must vacate and return keys (where applicable) and/or notify HRL of their departure within 48 hours of withdrawal or termination. If Resident fails to remove personal belongings or to clean the room after the Resident has vacated. The Resident agrees that vacate within this period, the University may determine these exercise any or all of the following options: (a) remove Resident and Resident’s possessions from the premises and xxxx Resident for the cost of possession removal and storage; (b) change the door locks and xxxx Resident for charges in its sole discretion related to changing the locks and creating new keys (where applicable); (c) xxxx Resident for all damages suffered by the University as a result of failure to vacate. C. Once Resident has checked out and handed over their keys (where applicable), any items left in a residence hall room or common area will calculate be collected and stored for 120 days after the charges to reasonably compensate residence halls are closed. On the 121st day the items will be discarded or donated. HRL will not be financially responsible for any damages based on its Common Residence Hall Charges Sheet, located at xxxx://xxxx.xxxx/ratesitems left in a residence hall space after Resident has checked out. e. Residents who do not intend to live on campus for Winter Term must vacate by 5:00 PM on December 7, 2018 and Residents who do not intend to live on campus for Spring Term must vacate by 5:00 PM on March 22, 2019. If a Resident fails to do this, they are subject to a $250 Extended Occupancy fee. f. End of Agreement Period: Unless Resident is graduating, Resident must remove check out, return all personal belongings from keys, and leave their room when room, suite or apartment in good order by the Occupancy period ends earlier of (1) twenty-four (24) hours after Resident’s last scheduled final examination of the Spring Semester or this Contract (2) noon after the last day of exams as published by the Office of the Registrar whichever occurs first. All Residential areas will be closed for all non- graduating students at noon on the last day of exams. Graduating Residents may stay until 6:00 PM of the day of Fall or Spring Graduation. If Resident is terminatedgraduating for Fall or will be leaving to participate in study abroad, Resident must cancel their Spring housing agreement by December 1st via the Agreement Release Request on the Housing Portal. The room Facilities (bedrooms, bathrooms, sinks, and university owned appliances and furniture, showers) must be cleaned and all keys returned to their respective service center prior to move out being completeleft in a reasonable state of cleanliness. Remaining personal items will be considered abandoned and will be sent to OSU Surplus for public auction or disposal. Within Agreement period: If Resident withdraws or terminates their enrollment during the academic year, or if Resident’s enrollment is terminated by the University, Resident must vacate and return keys (where applicable) and/or notify HRL of their departure within 48 hours of withdrawal or termination. If Resident fails to remove personal belongings or to clean the room after the Resident has vacated. The Resident agrees that vacate within this period, the University may determine these exercise any or all of the following options: (a) remove Resident and Resident’s possessions from the premises and bill Resident for the cost of possession removal and storage; (b) change the door locks and bill Resident for charges in its sole discretion related to changing the locks and creating new keys (where applicable); (c) bill Resident for all damages suffered by the University as a result of failure to vacate. C. Once Resident has checked out and handed over their keys (where applicable), any items left in a residence hall room or common area will calculate be collected and stored for 120 days after the charges to reasonably compensate residence halls are closed. On the 121st day the items will be discarded or donated. HRL is not responsible for any damages based on its Common Residence Hall Charges Sheet, located at xxxx://xxxx.xxxx/ratesitems left in a residence hall space after Resident has checked out. e.
