NEPA Support – EIS Addendum. The USACE completed a Final Programmatic Environmental Impact Statement (PEIS) under NEPA for the MREFPP in July 2017, and the Record of Decision was issued for the MREFPP on December 19, 2017. The PEIS addressed general impacts associated with construction of the MREFPP as well as site-specific impacts associated with the first phases of design, collectively known as CS 1.5. The PEIS prepared for the MREFPP described site- specific impacts associated with Phases MI-1, MI-2, and MI-3. Similarly, a second PEIS will be required for Phases MI-6 and MI-7 since they are not part of CS 1.5. In order to have a complete system, it is assumed that the proposed PEIS will also include the additional phase of the MREFPP located to the south of the Xxxxxxx Expressway that completes CS 2. This task will develop a DRAFT Programmatic Environmental Impact Statement (PEIS) for the Mouse River Enhanced Flood Protection Project Construction Stage No. 2 (CS 2). The USACE St. Xxxx District will serve as the lead federal agency responsible for preparing NEPA documentation, with the USACE Omaha District providing regulatory and technical assistance. The PEIS document development will be led on behalf of the XXXX by the Xxxx team; however, technical information and support by the HEI will be required.

For the purposes of this section, the Contractor warrants and represents that it is authorized and empowered to and hereby grants the State and the third-party provider of MFMP the right and license to use, reproduce, transmit, distribute, and publicly display within the system the information outlined above.   • Conversion of Wholesale Services to Network Elements or Network Elements to Wholesale Services Upon request, BellSouth shall convert a wholesale service, or group of wholesale services, to the equivalent Network Element or Combination that is available to Global Dialtone pursuant to Section 251 of the Act and under this Agreement or convert a Network Element or Combination that is available to Global Dialtone pursuant to Section 251 of the Act and under this Agreement to an equivalent wholesale service or group of wholesale services offered by BellSouth (collectively “Conversion”). BellSouth shall charge the applicable nonrecurring switch-as-is rates for Conversions to specific Network Elements or Combinations found in Exhibit A. BellSouth shall also charge the same nonrecurring switch-as-is rates when converting from Network Elements or Combinations. Any rate change resulting from the Conversion will be effective as of the next billing cycle following BellSouth’s receipt of a complete and accurate Conversion request from Global Dialtone. A Conversion shall be considered termination for purposes of any volume and/or term commitments and/or grandfathered status between Global Dialtone and BellSouth. Any change from a wholesale service/group of wholesale services to a Network Element/Combination, or from a Network Element/Combination to a wholesale service/group of wholesale services, that requires a physical rearrangement will not be considered to be a Conversion for purposes of this Agreement. BellSouth will not require physical rearrangements if the Conversion can be completed through record changes only. Orders for Conversions will be handled in accordance with the guidelines set forth in the Ordering Guidelines and Processes and CLEC Information Packages as referenced in Sections 1.13.1 and 1.13.2 below.
