No Benefit Without Notice. No holder (“Leasehold Mortgagee”) of a Leasehold Mortgage on this Agreement shall have the rights or benefits mentioned in this ARTICLE, nor shall the Port be bound by this ARTICLE, unless and until an executed counterpart of such Leasehold Mortgage (or any assignment thereof), together with a written notice setting forth the name, address, contact person (or department) for the Leasehold Mortgagee, is delivered to the Port. The Leasehold Mortgagee may designate other contact information by providing notice thereof to the Port in the manner provided by Section 26.1 of this Agreement.

The Leasehold Mortgage may be assigned by the Leasehold Mortgagee; provided, however, that the Port shall not be bound to recognize any assignment of said Leasehold Mortgage unless and until the Port shall be given written notice of such assignment and the name, address, contact person (or department) for the assignee(s), with identification of a single representative who is authorized to receive notices on behalf of the assignees, if more than one, and thereafter such assignee(s) shall be deemed to be said “Leasehold Mortgagee” and shall be bound by all provisions of the Lease as amended hereby pertaining to mortgaging of the Premises.

  • Maximum Enrollment The maximum number of students who may be enrolled in the School shall be 550 students, unless the School and District mutually agree to increase this number. This maximum enrollment was determined pursuant to negotiations between the District and the Network for the School and is consistent with facilitating the academic success of students enrolled in the School and facilitating the School’s ability to achieve the other objectives specified in this Contract. If the School wishes to enroll more than the maximum number of students listed above, the Network for the School must submit a written request to the District, in form and substance acceptable to the District, for review and consideration as an amendment to this Contract. The District shall approve any reasonable requests as determined by the District. This maximum enrollment should not exceed the capacity of the School facility. Each year, the School will be asked to affirm an annual maximum enrollment that will be used to determine mid-year enrollment and School Choice numbers.

  • Court Appearance Leave Without Pay An employee may request and shall be granted leave without pay for the time required to make an appearance as a plaintiff or defendant in a civil or criminal court proceeding that is not connected with the employee's officially assigned duties. However, reduction in salary will not be made for an FLSA-exempt employee to testify in court or at a deposition except for full workweek increments where such testimony causes an absence of one (1) or more full workweeks.

  • Right to Return A promoted employee shall have the right to return to his/her previous position provided that he/she notifies his/her Department Head and the Secretary of the Civil Service Board of his/her intention to do so within 60 calendar days of the date the employee commences work in the promoted position.

  • Employee Notice After review of the employee’s timely response, if any, the University shall notify the employee of any action to be taken.
