No Construction Phase Change Order. Based on Course of Conduct or Order by Unauthorized Person No course of conduct or dealings between the Parties, nor express or implied acceptance of alterations or additions to the Work, and no claim that the Department has been unjustly enriched shall be the basis for any claim, request for additional compensation, or extension of a Completion Deadline. Further, the Progressive Contractor shall undertake, at its risk, work included in any request, order, or other authorization issued by a Person in excess of that Person’s authority as provided herein or included in any oral request. The Progressive Contractor shall be deemed to have performed such work as a volunteer and at its sole cost. In addition, the Department may require the Progressive Contractor to remove or otherwise undo any such work, at the Progressive Contractor’s sole cost.

  • PRE-CONSTRUCTION PHASE FEE The Pre-Construction Phase Fee is the total compensation payable to Contractor for the performance of Pre-Construction Phase Services, except for Additional Pre-Construction Phase Services approved in advance and in writing by Owner. The Pre-Construction Phase Fee shall be a lump sum amount based on the AACC established in this Agreement.
