No Discrimination (Union Membership, Activity and Representation). (A) The City recognizes the right of all eligible employees to be free to join the Union and to participate in lawful concerted Union activities. Therefore, the City agrees there shall be no discrimination, interference, restraint, coercion or reprisal by the City against any employee as a result of Union membership or the lawful activity of any member acting in an official capacity on behalf of the Union. (B) In filling job vacancies, the City agrees that any union members appearing on a properly certified Civil Service Commission eligible list shall not be discriminated against as a result of such Union affiliation.
