Common use of NO SMOKING ALLOWED Clause in Contracts

NO SMOKING ALLOWED. No smoking will be allowed inside the property. If the house has been smoked in, your security deposit will be forfeited. Should there be anyone that smokes outside, all cigarette butts should be removed when you leave. Should the housekeeper have to pick up any remaining cigarette butts from outside the property, there will be a deduction from your deposit. CANDLES & FIRE HAZARDS: No candles will be allowed inside or outside the property. No fire of any kind allowed ie: bonfires etc. BBQ smoker/cooker can be used outside. No cooking on or near wooden decking. All charcoal should be disposed of properly to not cause any fire or fire hazard and removed from the property when the Xxxxxx’s vacate the property. SECURITY DEPOSIT: The security deposit is $300 for 2-15 nights, $500 for 16-27 nights and $1500.00 for 28+ nights. Deposits can be made by credit card, money order or cash. Security deposit is refundable within 14 days after check out provided that the real and personal property are in the same condition as when the renter took possession of the vacation rental and all terms of this agreement are met. Any changes in dates for the property reserved will result in a $25 non-refundable fee. If there is a change in the property location, the $300/$500/$1500 deposit will be forfeited and a new deposit will be required. Renter is liable for all replacements & repairs that are outside what is normal wear & tear. All trash that is left behind in the rental will be removed by the property manager with a deduction from your deposit. Please see house rules as to garbage instructions. This renter is responsible for the reservation and for all family members, guest and activities in the rental of the home during the scheduled dates of the rental.

An early check in time is allowed only when the property is cleaned and ready for occupancy. PRIOR APPROVAL IS REQUIRED. HOLD HARMLESS: Property owners as well as property management do not assume any liability for loss, damage or injury to persons on their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, Dish TV, internet, appliances, electricity or plumbing. Nor will we accept liability for any loss or damage caused by weather conditions, natural disaster acts of God or other reasons beyond our control. RELEASE AND INDEMNITY: The undersigned renter for himself/herself, his/her heirs, assignors, executors and administrators hereby agree to indemnify; defend or release and hold property owners and Kayaker’s Kabin harmless from any and all claims, demands and causes of action by reason of an injury to PERSON or PROPERTY of whatever nature which has or have occurred, or may occur to the undersigned, or any or his/her guests as a result of or in connection with the occupancy of the LEASED premises including any claim or suit arising there from.
