Non-Discrimination in Client Services. The Agency shall not deny an otherwise qualified individual any services or other benefits provided under the Project Services Agreement on the grounds of race, color, sex, religion, national origin, creed, marital status, age, sexual orientation, political ideology, ancestry, or the presence of any sensory, mental or physical handicap. The Agency shall not discriminate on any of the foregoing grounds in the awarding of any contract, in the provision of services, or in other activities made possible by the Project Services Agreement. This prohibition also applies to discriminatory use of any criteria or methods of administration in determining: (i) the types of services or other benefits to be provided to an individual; or (ii) the class of individuals to whom, or the situation in which, such services or other benefits will be provided; or (iii) the class of individuals to be afforded an opportunity to participate--any of which may have an effect of subjecting individuals to discrimination on the prohibited grounds or may have the effect of defeating or substantially impairing their opportunities.

The undersigned shall require that the language of this certification be included in the award documents for all agreements at all tiers (including sub-agreements, and agreements under grants, loans and cooperative agreements) and that all Subrecipients shall certify and disclose accordingly.

Deny an individual any services or other benefits provided under this agreement or any resultant contract with an owner or operator; or b. The Service Provider, in determining the types of services or other benefits to be provided, the class of individuals to whom services or benefits will be provided, the situation in which such services or other benefits will be provided, or the class of individuals to be afforded an opportunity to participate in any services or other benefits, will not utilize criteria or methods of administration which have the effect of subjecting individuals to discrimination because of their race, color, sex religion, national origin, creed, age or disability.
