Non-Renewal of a Matrix Contract. If it is the intention of the Superintendent not to recom- mend, or the Board not to renew, a matrix person(s) con- tract(s), the matrix person shall have the right to appeal (prior to any action of the Board) to the Board in executive session with TAAP representation, if desired, and shall re- tain those rights of action provided for in Article VII-E, herein. If a matrix person(s) is referred to the Administra- tive Performance Program (APP), and the board reaches a simple majority vote to non-renew the matrix person(s) contract then the matrix person(s) do not have those rights in Article VII-E, herein 1. O.R.C. 3319.16, or For Cause i. To accept the recommendation of the Human Re- sources Office; or ii. To request TAAP to arbitrate the proposed recom- mendation pursuant to Article II, C and Section E-2, below, of this agreement; or iii. To follow the procedure as prescribed in Section 3319.16 of the Ohio Revised Code. This election must be in writing signed by the matrix person and be delivered to the Human Resources Office, with a copy to TAAP, within fifteen (15) calendar days after the receipt by the matrix person of the recommendation of the Human Resources Office. This election is final and binding on all parties and may not be changed except by mutual agreement of the Human Resources Office, TAAP, and the matrix person. Failure to deliver such election by the matrix person within such fifteen (15) calendar days period shall constitute an election of option a, above. Election of arbitration under b, above, con- stitutes waiver of all rights to challenge the termi- nation under 3319.16 of the Ohio Revised Code. Election of c, above, waives all rights to challenge the termination under the grievance or arbitration procedure of this contract. The decision of the ar- bitrator shall be final and binding on the Board, the matrix person, and TAAP.

  • Non-Renewal of Agreement The Company may terminate Executive’s employment by providing a timely Non-Renewal Notice, pursuant to Section 1(a).

  • Renewal of Contract If a Board representative does not inform the Superintendent in writing on or before the seventh day after the regular December board meeting of the Board’s intention to consider the nonrenewal or amendment of this contract, the contract will automatically renew for a period of one year from and after the expiration date provided in Section 1 of this contract. The Superintendent shall remind the Board in writing of this provision no later than its regular November meeting of each year of this contract and shall make the renewal of his employment contract an agenda item for the regular December board meeting during each year of this contract. At the time of each contract renewal and/or amendment, the Superintendent shall be responsible for taking all necessary steps to insure that the district has complied with the Superintendent Pay Transparency Act.

  • Renewal of Agreement This agreement does not automatically renew, and residence in UCF DHRL residence facilities during one agreement period does not guarantee that residence accommodations will be offered to the Student for any following periods. The Student is solely responsible for the timely completion of housing agreements for future periods. UCF DHRL housing agreements shall not be re-offered to residents who are unwilling to adhere to the basic elements of good housekeeping, and community living. UCF DHRL housing agreements shall not be re-offered to residents who disregard or violate rules, regulations, or policies established for governing UCF DHRL residential facilities. Finally, housing agreements shall not be re-offered to residents who have outstanding charges from UCF DHRL.

  • Non-Renewal Any grounds for termination stated in Section 24(c) above also may be grounds for non-renewal. In addition, the State Board or Local Board may elect not to renew the Charter if the petition for renewal does not comply with the Charter Schools Act and the rules, regulations, policies, and procedures promulgated in accordance with the Charter Schools Act or if the State Board or Local Board deems that the Charter School has not sufficiently increased student achievement or is no longer in the public interest.

  • AGREEMENT RENEWAL This Agreement shall not bind nor purport to bind the AZDOHS for any contractual commitment in excess of the original Agreement period.

(c) If the Notice is given by the Executive for Good Reason, the Executive may cease performing his duties hereunder on or after the date fifteen days after the delivery of Notice of Termination and shall in any event cease employment on the Termination Date. If the Notice is given by the Company, then the Executive may cease performing his duties hereunder on the date of receipt of the Notice of Termination, subject to the Executive’s rights hereunder. (d) The Executive shall have thirty days, or such longer period as the Company may determine to be appropriate, to cure any conduct or act, if curable, alleged to provide grounds for termination of the Executive’s employment for Cause under this Agreement pursuant to Section 1(f)(iii). (e) The recipient of any Notice of Termination shall personally deliver or mail in accordance with Section 23 written notice of any dispute relating to such Notice of Termination to the party giving such Notice within fifteen days after receipt thereof; provided, however, that if the Executive’s conduct or act alleged to provide grounds for termination by the Company for Cause is curable, then such period shall be thirty days. After the expiration of such period, the contents of the Notice of Termination shall become final and not subject to dispute.
