NRC. The Nuclear Regulatory Commission, or any successor thereto. NYPA. The Power Authority of the State of New York. NYPA Transmission Adjustment Charges (“NTAC”). A surcharge on all Energy Transactions designed to recover the Annual Transmission Revenue Requirement of NYPA which cannot be recovered through its TSC, TCCs, or other transmission revenues, including, but not limited to, its ETA revenues. This charge will be assessed to all Load state-wide, as well as Transmission Customers in Wheels Through and Exports.

NRC. As promptly as practicable, but in no event later than twenty (20) days after the date of this Agreement (unless a later date is mutually agreed between the Parties), Buyer and Seller or the Company shall cause to be filed with NRC a joint Application for Order Approving License Transfers and Proposed Conforming License Amendments for the Facility. The application shall include a request for NRC prior written consent to the cancellation of the Support Agreements. Buyer shall have primary responsibility for preparing all such filings and any NRC fees shall be borne solely by Bxxxx. Thereafter, Buyer and Seller and the Company, as applicable, shall cooperate with one another to facilitate NRC review of the application, including by providing the NRC staff with such documents or information that the NRC staff may request or require any of the Parties to provide or generate.
NRC. The final rule will clarify licensees' authority and res ponsibility for nuclear materials regarding termination of licenses. The final rule also sets forth procedures licensees must follow at the time of license termination. This will reduce uncertainties in licensing procedures, reduce communications necessary to obtain necessary information, and allow for orderly termination of licenses.
NRC. Consistent with its role as an independent safety and security regulator and the statutory requirements under the BIL governing DOE certification of applicant nuclear reactors for participation in the Civil Nuclear Credit Program, the NRC, after receiving a request from DOE, will convey to DOE whether the NRC has reasonable assurance that an applicant nuclear reactor (1) will continue to operate according to its current licensing basis and (2) poses no significant safety hazards. It is understood, consistent with the limited statutory timeframe under the BIL for DOE to render certification decisions after the close of the application period, that the NRC’s responses to these DOE requests will be based on the current status of the reactor under the NRC’s licensing and regulatory oversight programs, and the NRC will not undertake any new licensing or regulatory reviews for purposes of the Civil Nuclear Credit Program certification process. The Director of the NRC’s Office of Nuclear Reactor Regulation, or the Director’s designee, is responsible for conveying the NRC’s responses to these DOE requests in a timely manner and will do so in writing.
NRC. Notwithstanding anything in this Agreement to the contrary, Owners shall not be restricted from any audit rights that they are required to have in order to comply with applicable Laws, including without limitation the requirements of the NRC.
