An employee shall be granted injury-on-duty leave with pay to a maximum of either special leave or sick leave he has accumulated, but not both, where it is determined by a Workers’ Compensation Board that he is unable to perform his duties because of: personal injury accidentally received in the performance of duties and not caused by the employee’s misconduct; or sickness resulting from the nature of employment; or over-exposure to or other hazardous in the course of his employment; if the employee agrees to pay the Employer any amount received by him the Worker’s Compensation Board for loss of wages in settlement of any claim he may have in respect of such injury, sickness or exposure, however that such amount does not stem from a personal policy for the employee or his agent has paid the premium. the parties are awaiting the decision of the Workers’ Compensation Board as to the compensability of the injury, the employee shall use his sick leave credits.
