Open Source and Third Party Licenses. The Platform: (i) includes certain open source code software and materials as further detailed in the Documentation (“Open Source Software”), that are subject to their respective open source licenses (“Open Source Licenses”); and (ii) may include third party proprietary software (which are not subject to Open Source Licenses) (“Third Party Software”), subject to their respective license agreement(s) (“Third Party Terms”). Such Open Source Licenses and Third Party Terms contain provisions concerning warranty, copyright policy and other provisions. By executing this Agreement, You hereby acknowledge and agree to comply with the terms and condition of the Open Source Licenses and Third Party Terms, as may be amended from time to time. In the event of any inconsistencies or conflicting provisions between the provisions of the Open Source Licenses and/or the Third Party Terms and the provisions of this Agreement, the provisions of the Open Source Licenses and/or Third Party Terms shall prevail.

Open Source and Third Party Licenses. Third Party Software may be used to provide the Services. Consult the terms of service or end-user license agreement for each application that you choose to install on the Product. Third Party Software that is open-source software may be covered by licenses other than those granted in this Agreement. You agree that any copies of Third Party Software shall contain the same copyright and proprietary notices that appear in the Software.

To the extent the GPL, other similar open source license agreements or other third party agreements require Licensor to provide rights to the applicable portions of the Xxxxxxx.xxx Software Product that are broader than the rights granted elsewhere in this agreement, then the GPL and/or other similar open source license agreements shall take precedence over the rights and restrictions set forth in this Agreement. Nothing in this Section 4.6 shall permit Licensee or any third party to use the Xxxxxxx.xxx Branding Features in connection with exercising the rights granted under the GPL, other similar open source license agreements or other third party agreements.
Open Source and Third Party Licenses. If any Software is subject to an open-source license that provides the end user with rights that are broader than this License, then such rights shall take precedence. Ciena warrants that using Software in accordance with its documentation will not subject you to any obligation to disclose, distribute or license your own software that interacts with Software.

The DevOps Toolkit may contain or require open source components. Ciena will provide a list of such open source components together with notices to You, in the documentation, readmes or notice files in connection with such third-party technology. Open source components are licensed under the terms of the applicable open source license. In the event of any conflict between the terms of this License and the terms of the applicable open source license, the terms of the open source license shall prevail.

By executing this Agreement, Licensee undertakes to strictly comply with the terms and condition of the Open Source Licenses, as may be amended from time to time. In order to comply with the Open Source Licenses, Licensee shall read the respective licenses or notices which are available within the Software's notice file (“Notice File”), as may be amended from time to time by Illusive, at its sole discretion. Such Notice File may also include certain notices and/or list of conditions with regard to certain Third Party Software (“Third Party Terms”). In the event of any inconsistencies or conflicting provisions between the provisions of the Open Source Licenses and the provisions of this Agreement, the provisions of the Open Source Licenses shall prevail. In the event of any inconsistencies or conflicting provisions between the provisions of Third Party Terms and the provisions of this Agreement, the provisions of the Third Party Terms shall prevail. Without derogating from the generality of the foregoing, it is clarified that any Open Source Software and Third Party Software are provided on an “AS IS” basis, without indemnity or warranty of any kind, whether express or implied. For clarity, the representations and warranties set forth in Section 6 hereunder shall not apply to any Open Source Software and Third Party Software.
