Examples of SOFTWARE shall in a sentence

  • Siemens and where applicable their licensors in the LICENSED SOFTWARE shall be free to use any feedback and/or technical data including audit data received from You resulting from your access to and use of the LICENSED SOFTWARE for any purpose for business purposes, including (without limitation) development, manufacture, marketing, product ordering, and maintenance or support of products and services.

  • Any component of the LICENSED SOFTWARE shall be used exclusively for the “MSIBTM".

  • Any output or execution errors resulting from improper installation or operation of the SOFTWARE shall not be deemed “defects” for purposes of the Limited Warranty.

  • The Licensee's continued use of the SOFTWARE shall be deemed to constitute acceptance of any revised terms.

  • CLIENT’S right to use the SOFTWARE shall begin upon the delivery of the SOFTWARE and shall be dependent on CLIENT’S payment of all applicable fees and CLIENT’S full compliance with the provisions of the license attached thereto.

  • Thereafter any OTHER SOFTWARE shall be deemed to be included within the definition of SOFTWARE and within the subject matter commercializable by the University under this Agreement.

  • For the avoidance of doubt, SOFTWARE shall not be regarded as a joint development but a sole development by SIEMENS, even if and insofar SOFTWARE is based on specifications provided by SURGIVISION.

  • Prototype versions of the SOFTWARE shall be made available to SURGIVISION according to the milestones set forth in ANNEX 3 and in accordance with Section 3.6. Depending on the demands of the INTEGRATION WORK, INFORMATION and DEVELOPMENT RESULTS regarding the SOFTWARE can be submitted in writing and/or orally.

  • The SOFTWARE shall initially be released for clinical use with the MAGNETOM ▇▇▇▇▇▇ and MAGNETOM Verio.

  • The obligation of confidentiality concerning the SOFTWARE shall last for the entire duration of the present Agreement and shall continue for the duration of the intellectual property rights as far as the SOFTWARE is protected with a right of intellectual property and/or remains confidential.

Related to SOFTWARE shall

  • Software Error means a reproducible defect or combination thereof in the Software that results in a failure of the Software when used in accordance with the Documentation. Software Errors do not include those errors caused by (a) Licensee’s negligence, (b) any unauthorized modification or alteration Licensee makes to the Software, (c) data that does not conform to Licensor’s specified data format, (d) operator error, or (e) use not conforming to the Licensor’s supported technical environment specified in the Documentation.

  • Oracle Open Source Service Offering(s) means the Oracle Linux Service Offering(s), the Oracle VM Service Offering(s), and the Oracle Verrazzano Service Offering(s).

  • Software License means a license for the Software granted under this ▇▇▇▇ to the Licensee;

  • Software Services means services that Customer provides to you that make available, display, run, access, or otherwise interact, directly or indirectly, with the Products. Customer must provide these services from data center(s) through the Internet, a telephone network or a private network, on a rental, subscription or services basis, whether or not Customer receives a fee. Software Services exclude any services involving installation of a Product directly on any End User device to permit an End User to interact with the Product.

  • Software Updates means the Software releases, service packs, build updates or emergency fixes released from time to time in accordance with the Vocera’s update policy for such Software.
