OPERATING EXPENSES; REAL ESTATE TAXES. This Sublease is a "triple net" or "NNN" sublease and Sublessee shall be responsible for paying directly for services such as utilities, janitorial costs, all operating expenses and annual increases (including without limitation building and common area maintenance such as parking, landscaping and lighting), costs of insurance, repairs, operations and real property taxes. Sublessee shall have the right to verify all operating expenses.
OPERATING EXPENSES; REAL ESTATE TAXES. Tenant shall pay Operating Expense Rent and Tax Rent as additional Rent hereunder in accordance with the following:
OPERATING EXPENSES; REAL ESTATE TAXES. The monthly rental rate includes all operating expenses and real estate taxes associated with the building, except PG&E and telephone service, which shall be the sole responsibility of LESSEE. Any increases in operating expenses or real estate taxes shall not be passed through to the tenant during the term of this lease. LESSEE shall be considered the owner during the term of any leasehold improvements installed at LESSEE’S expense, and any such leasehold improvements shall be assessed to LESSEE for property tax purposes. LESSEE shall not remove from the premises any leasehold improvements installed by LESSEE without LESSOR'S prior written consent. All real property taxes shall be paid by LESSOR. No portion of said taxes or any increases shall be passed on to LESSEE during the lease term or option period.
OPERATING EXPENSES; REAL ESTATE TAXES. Reference is made to Article 6 of the Lease. The parties agree that said Article 6 shall apply with respect to the payment of Operating Expenses and Real Estate Taxes during the Extended Period.
OPERATING EXPENSES; REAL ESTATE TAXES. This is a "gross" sublease. Sub-Subtenant shall have no obligation pursuant to Article 7 of the Master Lease or under paragraph 9 of the Master Sublease, to pay Sub-Sublandlord operating expenses or real estate taxes.
OPERATING EXPENSES; REAL ESTATE TAXES. Lessee shall pay, as Additional Rent, Lessee's Share (as hereinafter defined) of the Operating Expenses (as hereinafter defined) and Real Estate Taxes (as herein defined). Additional Rent shall be paid together with Base Rent, in advance, in monthly installments equal to one-twelfth (1/12th) of the annual Additional Rent payable during the applicable Lease Year as reasonably estimated by Lessor.
OPERATING EXPENSES; REAL ESTATE TAXES. Sub-Sublessee shall have the right to verify all operating expenses.
OPERATING EXPENSES; REAL ESTATE TAXES. The base year shall be 2005. The Sublessee shall be responsible for it’s pro rata share of the operating expense increases.
OPERATING EXPENSES; REAL ESTATE TAXES. Subtenant shall pay to Sublandlord its proportionate share (22.83%) of Sublandlord’s operating expenses and real estate taxes above the Base Year of 2013 as additional rent on a monthly basis, commencing on the Sublease Commencement Date.
OPERATING EXPENSES; REAL ESTATE TAXES. Tenant shall pay its pro rata share of the increase in "Operating Expenses and Real Estate Taxes" (defmed below) during the terin of this lease as additional rental (hereinafter, "OE Rent").* OE Rent shall be determined in the following manner:
(a) The base year, for the purposes of this paragraph, is defined as the calendar year 1997.
(b) After the end of each calendar year, Landlord shall furnish Tenant with a statement setting forth the Operating Expenses and Real Estate Taxes for the preceding calendar year, and the Operating Expenses and Real Estate Taxes for the base year. Tenant shall receive an invoice showing its pro rata share of the Increase in Operating Expenses and Real Estate Taxes for the most recent calendar year over the base year, which amount shall be Tenant's OE Rent with respect to such year. Tenant shall pay the OE Rent to Landlord within ten (10) days from date of receipt of the invoice.
(c) In addition to paragraph (b) above, Landlord shall have the right to collect OE Rent in twelve (12) monthly installments over the course of each year, on the first (I st) day of each month. The monthly installments shall be in an amount reasonably estimated by Landlord to pay the OE Rent due for such year, taking into account payments previously made during such year. After the end of the calendar year, tenant shall receive a statement showing the actual Operating Expenses and real Estate Taxes for that year and the amount paid by Tenant by installments during such year. If Tenant's pro rata share of the actual increase is greater than the amount paid by Tenant by installments during such year , Tenant shall within ten (10) days of receipt of the statement remit the the excess to Landlord. If Tenant has paid during such year an amount greater than its share of actual Operating expense and Real Estate Taxes increases, Landlord shall credit such excess against the estimated operating expense adjustments next due.
(d) The adjustment described in paragraph (c) shall be made each ensuing year. Tenant shall continue to pay the estimated OE Rent each month until Landlord notifies Tenant of any change in the amount of the OE Rent.
(e) If the lease contains any period less than a full calendar year, then the amounts payable under either paragraph (b) or (c) shall be prorated for the period of time the lease is in effect.
