Common use of Out-of-Rank Hours Clause in Contracts

Out-of-Rank Hours. Any employee who is temporarily required to perform at a higher-ranking 17 position and performs the responsibilities of the higher-ranking position shall be paid at a rate of compensation 18 equal to an amount fifteen percent (15%) greater than the employee’s base hourly wage for all hours worked in 19 the higher-ranking position during that workday. Probationary employees shall not perform at a higher-ranking 20 position.
