Outside Service Contracts. The District agrees that should the District desire to delegate responsibility for maintenance or for supervision of the District’s System to any individual or entity other than its own employees holding any permit or certificate required by law or a sewage plant operator holding a valid certificate of competency issued under the direction of the TCEQ as required by Texas Water Code Section 26.0301, as amended, or any other permit or certificate required by law, then any such proposed service arrangement, by written contract or otherwise, must be approved in writing by the Director, whose consent shall not be unreasonably withheld, prior to execution by the parties. Failure of the District to submit any such proposed service agreement to the District prior to its execution shall be considered an Event of Default. Any outside service agreement, whether submitted to the City or not, shall contain a clause terminating the service agreement as to the District on the date of annexation of the District by the City.

Outside Service Contracts. Subject to the direction of the BOARD, SITE MANAGER shall obtain bids for outside services on behalf of the ASSOCIATION for trash removal, parking lot snow plowing, tree and shrub fertilization, weed control, pest control and such other services for the common and limited elements of the COMPLEX, at additional expenses to the ASSOCIATION and as provided in the annual budget. When the anticipated dollar amount of the individual project or annual aggregate of expenditures exceeds $1,000, SITE MANAGER shall obtain up to three (3) bids whenever it is practicable and possible. On projects where SITE MANAGER shall also be deemed by the BOARD as a qualified bidder, SITE MANAGER shall follow the bidding policies as established by the BOARD in procuring and evaluating the bids received. It is the general intent of this section to assure that the most cost effective and qualified contractor(s) are retained to perform ASSOCIATION work in a professional manner following all codes, Federal, and Local and provide evidence of current liability and xxxxxxx’x compensation insurance.

Another contract between the Service Provider and the Recipient (for example, a loan or guarantee by the Service Provider) is considered to create a contract termination penalty if that contract contains terms that are not customary or arm’s length that could operate to prevent the Recipient from terminating the Service Contract. A requirement that the Recipient reimburses the Service Provider for ordinary and necessary expenses, or restrictions on the hiring by the Recipient of key personnel of the Service Provider are not treated as contract termination penalties. If the Recipient chooses to apply the following safe harbors, a Service Contract is a Qualified Service Contract if entered into before (and not materially modified after) August 18, 2017 and all of the following conditions are satisfied:

  • Covered Contracts and Contractors If the Contract exceeds $100,000 and the Contractor employed more than 40 full-time employees on a single working day during the previous 12 months in Minnesota or in the state where it has its principle place of business, then the Contractor must comply with the requirements of Minnesota Statute § 363A.36 and Minnesota Rule Parts 5000.3400-5000.3600. A Contractor covered by Minnesota Statute § 363A.36 because it employed more than 40 full-time employees in another state and does not have a certificate of compliance, must certify that it is in compliance with federal affirmative action requirements.

  • BUILDING SERVICES CONTRACTS In compliance with Article 9, Section 230 of the New York State Labor Law:

  • PUBLIC WORKS AND BUILDING SERVICES CONTRACTS Work being done under a resulting Authorized User Agreement may be subject to the prevailing wage rate provisions of the New York State Labor Law. SHORT TERM EXTENSION In the event a replacement Contract has not been issued, any Contract let and awarded hereunder by the State, may be extended unilaterally by the State for an additional period of up to 3 months upon notice to the Contractor with the same terms and conditions as the original Contract including, but not limited to, prices and delivery requirements. With the concurrence of the Contractor, the extension may be for a period of up to 6 months in lieu of 3 months. However, this extension terminates should the replacement Contract be issued in the interim. PROCUREMENT INSTRUCTIONS Authorized Users should refer to the documents attached as Appendix G – Processes and Forms Templates for specific instructions on the usage of this Contract. OGS reserves the right to unilaterally make revisions, changes, additions and/or updates to the documents attached as Appendix G - Processes and Forms Templates without processing a formal amendment and/or modification. SPECIFICATIONS During the term of the Contract, the Authorized User may request Product specifications for particular items that have been included by the Contractor in its Pricing Pages. These specifications will be provided by the Contractor at no cost.

Agency’s consent to any contract or subgrant will not relieve Grantee of any of its duties or obligations under this Grant.
