OVERTIME AND OVERTIME RATES. 20:01 An employee required to return to work within sixteen (16) hours from the start time of his regular shift will be paid the applicable overtime rate. 20:02 Employees will receive time and one-half (1.5) for all hours worked on Saturday and all hours worked in excess of eight (8) hours in a day. All shifts scheduled on Sundays, paid holidays, a Saturday that falls on a long weekend, or those in excess of twelve (12) hours per day shall be paid at the rate of double time. 20:03 For off-shift workers, unless otherwise agreed upon the shift which commenced on the evening of the holiday shall be considered as the shift for that holiday. 20:04 The Company will endeavour to equalize overtime among the employees usually performing the work within their classification and shift as follows: (a) In the event of overtime scheduling, the lowest overtime employee shall be asked; however, it is agreed that when the overtime listing is posted in the plant and prior to any overtime commencing, the employee must bring forward any errors or omissions to his/her Supervisor first, and if there is no resolution, then the employee will bring the matter forward to his/her union representative for review. (b) For the purposes of overtime scheduling, with the exception of the Production Operator and Loader/Packer/Operator classifications, the order for asking is as follows: (1) Employees on-shift in classification; (2) Employees off-shift in classification; (3) Employees on-shift holding back-up positions; (4) Employees on-shift with the skill and ability to perform the work; (5) Employees off-shift with the skill and ability to perform the work. Overtime for the Production Operator and Loader/Packer/Operator classifications will be offered to all seniority employees by classification by shift, then to any off-shift employees who have not been scheduled to work and make themselves available or agree to work a double shift or who inform the Company they wish to work outside their classification, then probationary employees, and then TPT’s in that order. For weekend and holiday overtime it is the responsibility of the employee to notify the Company, by the end of their Tuesday shift, of their desire to work a double shift, out of class, or off-shift overtime in the Production Operator / Loader/Packer/Operator classification. Any errors or omissions for overtime pay will be adjusted on the next regular payroll submission; (d) In the event an employee does not get twenty-four (24) hours notice of weekend overtime or four (4) hours notice of daily overtime. Then the employee will not be charged for the overtime worked should he or she exercise his or her right to refuse. (e) Should an employee be absent because of sickness, accident, compensable injury, leave of absence, or vacation, (except in the case of an approved bereavement or suspension) such employee will be charged for all overtime hours he or she would have been scheduled to work had they not been absent for the above shown reasons. If an employee is absent from work it is their responsibility to contact the Company through the plant attendance line prior to the end of their shift on Thursday regarding their availability to work weekend or holiday overtime. (f) New seniority employees will be credited with the highest overtime hours plus one (1) of the highest overtime employees within his classification. (g) A seniority employee who successfully posts into a classification will be given the average overtime hours of all employees in the classification on that shift. (h) Employees who are performing modified light duty work will be offered overtime work only if they are qualified to perform the work and their restrictions permit them to perform the required overtime work. The provisions of Article 24 will not apply to modified workers on premium or weekend overtime. (i) If an employee is asked to work overtime outside their classification, they will only be charged for hours they work outside the classification. 20:05 If there are insufficient volunteers for Saturday overtime to meet customer demand in any required classification, the Company will schedule the individuals with the lowest overtime worked hours by shift in each of the classifications required to work overtime at the applicable overtime rate with the following exceptions: (i) Saturday immediately preceding or following an employee’s scheduled vacation; (ii) Saturday immediately following a Friday holiday; (iii) Saturday immediately preceding a Monday holiday; (iv) Saturday immediately following an employee’s approved Friday PPH or immediately preceding an employee’s approved Monday PPH. The Company will post a notice of mandatory overtime for all employees by the end of their shift on Thursday, as to whether mandatory overtime is required on Saturday. In recognition of the Company agreeing that Sunday and Holiday overtime is voluntary for employees, the parties agree that if there are an insufficient number of employees able or willing to work overtime, the Company has the right to have any other person work overtime hours, and no grievance shall be filed with respect thereto. 20:06 Bargaining unit employees will be given preference for all inventory related work performed by bargaining unit employees. 20:07 At the beginning of each calendar year, overtime records shall be reduced to zero (0). If an employee works a double shift (12 hours) they will be provided an additional paid break of ten (10) minutes at the end of the first six (6) hour shift and ten (10) minutes at the start of the second six (6) hour shift. When the Company is required to call employees at home to attend for overtime work, a member of the shop committee or their designate shall be present to verify the call. An employee who fails to answer the phone will be by-passed and charged as a no and the next eligible employee will then be called. If an employee calls back prior to the overtime being staffed, the employee will be given the opportunity to work the overtime. 20:08 An employee who is laid-off from their classification will be credited with the average overtime hours in their new classification on that shift. An employee who resigns from their classification will be placed in the production classification and credited with the highest overtime hours plus one (1). Employees will carry their current overtime hours regardless of movement to any other shift within their respective classification. (1) Overtime and Attendance are tracked through the RPM system. When an employee is averaged, the hours will be rounded off to the nearest whole number. (2) Any cancellations of overtime once the overtime schedule has been posted will be charged as a “No Show” and will be charged double the number of hours scheduled, unless twenty-four (24) hours notice is given prior to the start of the overtime commencing. (3) Employees absent from work at the time of the overtime canvassing and who have not notified the Company of their intention to work overtime on the weekend by contacting the attendance line will be charged as a no and cannot bump another employee.
