Owner Taxes. (a) If Contractor is assessed any taxes, for tangible personal property and services purchased for the purpose of and in conjunction with constructing of the Project despite having complied with the requirements of Section 4.2.1, Contractor will invoice Owner for reimbursement of such assessment as part of each applicable Request for Payment, and shall include therewith all documentation necessary to evidence Contractor’s and Subcontractor’s payment of such taxes. For the avoidance of doubt, Owner will not be responsible: (i) to reimburse Contractor for those Contractor’s Taxes as described in Section 4.2.1(a); or (ii) for any penalties or interest related to non-payment or late payment of any required Contractor’s Taxes, unless such non-payment or late payment is due to or caused by the instruction of Owner to Contractor, as provided in Section 4.2.1(c)(ii).
(b) Owner shall administer and pay all sales, use, gross receipts, income, value-added and withholding taxes and duties, and any other similar taxes or contributions (including penalties and interest related to such taxes), imposed by any taxing authority: (i) that are measured by Owner’s sale of electricity from the Project; and (ii) upon services or labor provided by Owner or any Other Owner Contractors in connection with the Project (collectively “Owner’s Taxes”). Owner shall furnish to the appropriate taxing authorities all required information and reports in connection with all such Owner’s Taxes.
(c) To the extent Contractor is legally obligated to pay any of Owner’s Taxes, Owner shall: (i) furnish to Contractor all information and reports required to be furnished to the appropriate taxing authorities in connection with all such Owner’s Taxes; and (ii) reimburse Contractor for the full amount of such Owner’s Taxes paid by Contractor.
Owner Taxes. Owner shall be responsible for the payment of all Taxes other than those Operator Taxes related to or associated with the Project, and as set forth in Section 3.16.
Owner Taxes. Owner shall pay all real property taxes assessed against the Property Site and any permanent use charges or assessments such as water or sewer (but excluding charges and taxes for construction utilities and fuel to be supplied by Contractor as required hereunder, which shall be Contractor’s responsibility), and Owner shall be responsible for the payment of state and local sales and/or use or excise taxes in connection with the purchase of any equipment, including rentals, leases and consumables (collectively, “Owner Taxes”) except for such Owner Taxes as Owner contests in good faith by appropriate proceedings (provided that if Owner is unsuccessful in any such contest Owner shall be responsible for the payment of such Owner Tax). In the event that Owner is required to pay additional state or local taxes because Contractor failed to follow reasonable written instructions of Owner appropriately, Contractor shall be responsible for the cost of such additional taxes.
Owner Taxes. The term shall include (1) real property taxes on the Site or the Project; (2) personal property taxes on all materials, equipment and machinery either expected to be or actually permanently incorporated into or attached to the Project; and
Owner Taxes. Owner shall pay all real property taxes assessed against the Property Site and any permanent use charges or assessments such as water or sewer (but excluding charges and taxes for construction utilities and fuel to be supplied by Contractor as required hereunder, which shall be Contractor’s responsibility), and, subject to Section 3.23, Owner shall be responsible for the payment of, or reimbursement to Contractor of, state or local sales and/or use or excise taxes in connection with the purchase of all Equipment (including rentals, leases and consumables), except for such taxes Owner contests in good faith (collectively, “Owner Taxes”). In the event that Owner is required to pay additional state or local taxes because Contractor failed to follow written instructions of Owner appropriately, Contractor shall be responsible for the cost of such additional taxes within thirty (30) days of Owner’s request therefor.
Owner Taxes. Owner shall pay any and all state, federal, and local sales and use taxes which may be assessed for the Owner Purchases, any taxes associated with income generated by the Facility, and, as between Owner and Contractor, any real property taxes on the Facility and/or the Site. Further, any property, sales, use, contractor's , gross receipts, value added, excise or local taxes paid by Contractor or Subcontractor shall, in accordance with Section 3.14 and Article 7, be reimbursed to Contractor or Subcontractor by Owner in addition to the payment of the Contract Price by Owner to Contractor pursuant to Article 7.

Owner Taxes. All prices reflected in the Agreement shall be inclusive of all applicable Taxes, except Owner Taxes. Owner shall bear all amounts payable for Owner Taxes following receipt from Contractor of an invoice therefor and reasonable documentation supporting the calculation thereof. Contractor shall timely collect and remit to the appropriate Governmental Authority all Owner Taxes, and Owner shall have no liability for any penalties and/or interest associated with the failure of Contractor to timely collect and remit such Owner Taxes to the appropriate Governmental Authority.
Owner Taxes. The Owner shall be responsible for the payment of corporation taxes levied on the Owner itself.
