PACKING, MARKING AND SHIPMENT. Where applicable, unless otherwise specified by Laborie in writing, Supplier shall pack and xxxx products so as to reasonably ensure that the products reach Laborie at its ultimate destination in a secure fashion. Purchase order number must appear on all invoices, packing slips and packages. Damage discovered after transfer of title that is determined to be a result of faulty packaging or handling by Supplier shall be Supplier's responsibility. All shipments shall be made DDP Laborie’s facilities set out on the Purchase Order (Incoterms 2000) unless otherwise mutually agreed upon in writing.

Supplier will pack and mark Supplies and make shipments in accordance with Xxxxx’s instructions, meet carrier requirements, comply with all Buyer’s transportation routing instructions and assure delivery free of damage and deterioration. Supplier is liable for losses suffered by Buyer as a result of packing, marking or shipping the Supplies in an inappropriate manner or contrary to the instructions of Buyer.

PACKING, MARKING AND SHIPMENT. Seller shall suitably xxxx, xxxx, and ship goods in accordance with the instructions of Buyer and the requirements of the carrier transporting such goods. Buyer shall not be charged for packing, marking, or shipping unless separately itemized on the Order. Buyer’s Purchase Order number must appear on the container, packing list, invoice, and any correspondence relating to the Order. Two copies of the packing list (providing the quantity and description of the goods contained therein) shall be placed within the container.

Seller shall prepare and pack all Work in accordance with applicable federal and state laws and regulations and good commercial practice so as to affect safe delivery without damage or loss. Seller shall mark each shipping container to show Buyer’s P.O. number or other Buyer reference number as part of the delivery address. Seller’s failure to do so will cause Buyer significant delivery difficulties and delays. Seller shall include in each container a packing list showing the P.O. number, part number, and quantity.

Whenever shipment is made by truck, Seller will enclose one of the packing slips (or packing slip sets in the case of multiple item shipments) in an envelope and Seller will record written instructions on the bill of lading directing the delivering driver to deliver the envelope to FCA US's traffic representative upon arrival at FCA US's facility. Seller is responsible for the goods until delivery at the designated delivery point in the Order.

Whenever shipment is made by truck, Seller will enclose one of the packing slips (or packing slip sets in the case of multiple item shipments) in an envelope and Seller will record written instructions on the bill of lading directing the delivering driver to deliver the envelope to DaimlerChrysler’s traffic representative upon arrival at DaimlerChrysler’s plant. Seller is responsible for the goods until delivery at the designated FOB point.

Unless otherwise specified by Samsung in writing, Supplier shall pack and xxxx the Products so as to reasonably ensure that the Products reach Samsung at its ultimate destination in a secure fashion. Secondarily, unless otherwise agreed to in writing by Samsung or requested by Samsung either through the Purchase Order or otherwise, Supplier shall attempt to secure the lowest transportation rates to meet carrier requirements and shall prepay all shipping charges. Damage discovered after transfer of title that is determined to be a result of faulty packaging or handling by Supplier shall be Supplier’s responsibility. Unless otherwise provided, the price stated in this Agreement shall include all charges and expenses with respect to containers, packing and crating, and for transportation to the mutually agreed destination. Notwithstanding, it is understood that the pricing set forth in Section 2.3a above is for the price of the Products only and does not include transportation. Purchase Order number, Harmonized Tariff Codes and Samsung part numbers, if applicable, must be shown on all packing slips and invoices and on all packages, crates, and other containers. Each shipment must contain a packing slip showing the number of pieces in the shipment. Samsung’s count shall be accepted as correct if any packing slip quantity is in dispute or the packing slip is omitted. In the event that there are any delays in the delivery of the Product(s) as a result of any regulatory requirements in connection with the Product packaging, Supplier shall be fully liable for any costs, loss or damages associated with such delay.

Seller will pack and mark goods and make shipments in accordance with AEC’s instructions, meet carrier requirements and assure delivery free of damage and deterioration. AEC’s complete purchase order number and part number must appear on all correspondence, invoices, shipping papers and packages.
