PAGA Payment. The PAGA Payment consists of $100,000 of the Gross Settlement Amount allocated to satisfy the PAGA penalties claim as alleged in the Class Action. Seventy-five percent (75%) of which ($75,000) shall be paid to the LWDA, and twenty-five percent (25%) of which ($25,000) shall be distributed to Eligible Aggrieved Employees, on a pro rata basis, as set forth below.
PAGA Payment. Class Counsel will also move the Court for and order of Final Approval (and associated entry of Judgment) releasing and barring any Released Claims of the Class Members who do not opt out of the Settlement.
PAGA Payment. The PAGA Payment consists of Fifty Thousand Dollars ($50,000.00) of the Gross Settlement Amount allocated to satisfy the PAGA penalties claim as alleged in the Class Action. Seventy-five percent (75%) of the PAGA Payment ($37,500.00) shall be paid to the LWDA, and twenty-five percent (25%) of the PAGA Payment ($12,500.00) shall be distributed to Eligible Aggrieved Employees, on a pro rata basis, as set forth below. Pursuant to California Labor Code § 2699(1)(2), settlement of a PAGA action must be approved by the Court and a copy of the proposed Settlement will be provided to the LWDA at the same time that it is submitted to the Court. In the event the LWDA objects to the Settlement, the Parties will meet and confer with the Court and the LWDA to reach a penalty allocation acceptable to all Parties that does not materially alter the terms of this Settlement.
PAGA Payment. The PAGA Payment consists of $20,000 of the GSA allocated to satisfy the PAGA penalties claim as alleged in the in the Complaint. Seventy-five percent (75%) of the PAGA Payment, $15,000, shall be paid to the LWDA, and twenty-five percent (25%), $5,000, of the PAGA Payment shall be distributed to the PAGA Members.
PAGA Payment. The Parties agree to settle the PAGA claims for $200,000. 75% of this amount, or $150,000, shall be paid to the LWDA and is referred to as the PAGA Payment. The remaining 25% of the $200,000, or $50,000, shall become part of the Net PAGA Settlement Amount payable to Eligible Aggrieved Employees.
PAGA Payment. The Claims Administrator shall make payment of the LWDA share of the PAGA Payment from the Gross Common Fund as set forth in Section III.14(g) of this Agreement.
PAGA Payment. 14. The Agreement provides for a PAGA Payment out of the Gross Settlement Amount of $50,000, which shall be allocated $37,500 to the Labor & Workforce Development Agency (“LWDA”) as the LWDA’s 75% share of the settlement of civil penalties paid under this Agreement pursuant to the PAGA and $12,500 to be distributed to the Aggrieved Employees based on their respective pay periods worked during the PAGA Period, which is June 1, 2019 through July 31, 2021. “
PAGA Payment. Fifty Thousand Dollars ($50,000.00) shall be allocated from the Maximum Settlement Fund for settlement of claims for civil penalties under the PAGA. The Settlement Administrator shall pay seventy-five percent (75%) of the PAGA Payment, or $37,500.00, to the California Labor and Workforce Development Agency (“LWDA”). Twenty- five (25%), or $12,500.00, will be part of the Net Settlement Amount and distributed to Settlement Class Members as described in this Agreement.
PAGA Payment. The PAGA Payment consists of $20,000 of the Gross Settlement Amount allocated to satisfy the PAGA penalties claim as alleged in the Action. Seventy-five percent (75%) of the PAGA Payment ($15,000) shall be paid to the LWDA, and twenty-five percent (25%) of the PAGA Payment ($5,000) shall be distributed to Eligible Aggrieved Employees (including those who submit a valid and timely Exclusion Form) proportionate to the number of pay periods that he or she worked during the PAGA Period. The PAGA Payment will be calculated by determining the total number of pay periods the Eligible Aggrieved Employees were employed during the PAGA Period (i.e., the sum of all pay periods of employment for each eligible aggrieved employee) and dividing that number into the $5,000 amount allocated to Eligible Aggrieved Employees to determine the monetary value assigned to each pay period. That number will then be multiplied by the individual eligible aggrieved employee’s total number of pay periods employed during the PAGA Period to determine that individual’s proportional share.
PAGA Payment. The PAGA Payment consists of $50,000 of the Gross Settlement Amount allocated to satisfy the PAGA penalties claim as alleged in the in the Complaint. Seventy-five percent (75%) of the PAGA Payment, or Thirty-Seven Thousand Five Hundred Dollars and Zero Cents ($37,500.00), shall be paid to the LWDA, and twenty-five percent (25%), or Thirteen Thousand Five Hundred Dollars and Zero Cents ($13,500.00), of the PAGA Payment shall be part of the Net Settlement Amount distributed to Participating Class Members.
