Parameters for Adjudication. The adjudicator shall decide the issue of the proper classification for the position based upon the existing classification system. (i) The adjudicator shall provide a decision, in writing, to the College and the Union within thirty (30) days of the referral. (ii) The decision of the adjudicator shall be final and binding on all parties, and grievance rights shall not apply in respect of a decision of the adjudicator. (iii) The adjudicator shall not: (1) alter any position descriptions and/or any classification standards determined by the College; (2) entertain an appeal based solely on the grounds of the inadequacy of pay rates negotiated for the classification assigned to the position occupied by the appellant Employee; (3) entertain an appeal in respect to a position that has been considered by it within the previous twelve (12) months, except where the appellant can demonstrate in writing that there has been a substantial change in the duties, responsibilities or requirements of that position since the position was last considered by the adjudicator.
