PARENT AWARD. This Agreement shall be read and interpreted in conjunction with the applicable award which relates to the relevant classification stream as outlined at Appendix "A" : The Electrical Contracting Industry (State) Award;The Metal and Engineering Industry (New South Wales) Award;The Building & Construction Industry(State) Award. Provided that, in each relevant Award category, where there is any inconsistency, this Agreement shall prevail to the extent of the inconsistency.
PARENT AWARD. This Agreement shall be read in conjunction with the Poultry Industry Preparation (State) Award (IRC no 7320 of 2004), The provisions of this Agreement shall override the provisions of the award where so mentioned. Where this Agreement is silent, the provisions of the award shall apply.
PARENT AWARD. This Agreement is to be read and applied in conjunction with the Butcher’s Wholesale (Newcastle and Northern) Award 2005, as varied from time to time. Wherever the terms of this Agreement are inconsistent with the terms of the Award, the terms of this Agreement are to be applied.
PARENT AWARD. 5.1 This Agreement is supplementary to, and shall be read and interpreted wholly in conjunction with, the Building Construction Industry Award State 2003 (hereinafter referred to as the “Parent Award”) being a Notional Agreement Preserving a State Award (NAPSA). The terms and conditions of the Parent Award, excluding those clauses outlined in clause 5.3 herein, are expressly preserved by this Agreement as if the same were set out in full herein and shall be binding upon the parties during the operation of this Agreement if not otherwise prohibited by law. No other Award or Certified Agreement (State or Federal) shall apply in relation to the employees covered by this Agreement.
5.2 Where this Agreement is silent the terms of the Parent Award, in so far as it has application, shall continue to cover and regulate the terms and conditions of employment in all other respects. In the event of any inconsistency between the Parent Award and a pro ion of this Agreement, the intent and terms of this Agreement shall prevail to the extent of such inconsistency unless contrary to law.
5.3 All clauses contained in Part 11 of the Parent Award are excluded by this Agreement and shall not apply.
PARENT AWARD. This Agreement totally regulates the terms and conditions of employment for employees covered by this Agreement. Upon termination of this Agreement, if no other Agreement has been agreed between the Company and the employees and/or their nominated representatives, the PFD Food Services (Qld) Pty Ltd Sales and Distribution Enterprise Award (the "Consent Award") will regulate the employees’ terms and conditions of employment
PARENT AWARD. A. This agreement shall be read and interpreted wholly in conjunction with the Grocery Products Manufacturers Awards as varied from time to time.
B. In the event of any inconsistency between this agreement and the award the terms of this agreement shall prevail.
C. This agreement shall not be used in any manner whatsoever to obtain similar arrangements or benefits in any other enterprise.
PARENT AWARD. This agreement shall be read in conjunction with the Clerical and Administrative Employees (State) Consolidated Award [Splinters 027 & 4214]. The provisions of this agreement shall override the provisions of the award where so mentioned. Where this agreement is silent, the provisions of the relevant award shall apply.
PARENT AWARD. Where this agreement is silent, the terms of the Transport Industry Mixed Enterprises (State) Award will apply; provided that the overall objective of this agreement is not subverted.
PARENT AWARD. Where this agreement is silent, the terms of the Metal, Engineering and Associated Industries (NSW) Award ("the award") shall apply. Where there is any inconsistency between this agreement and the award, this agreement shall override the award to the extent of the inconsistency.
PARENT AWARD. To the extent allowed under the Workplace Relations Act 1996 (Cth), this agreement incorporates all the terms of the Metal and Engineering Associated Industries Award as in operation just before the making of the agreement, provided that where there is any inconsistency between the agreement and the award, the agreement shall take precedence to the extent of any inconsistency. This provision does not apply to any term of the award which is specified as prohibited content by legislation or regulation, or which does not pertain to the relationship between the employer and employees subject to this agreement.
