PARTICIPATION IN OTHER PROCEEDINGS. At the County’s request, the Consultant shall allow itself to be joined as a party in any legal proceeding that involves the County regarding the design, construction, or installation of any matter which is the subject of this Agreement. This provision is for the benefit of the County and not for the benefit of any other party.
PARTICIPATION IN OTHER PROCEEDINGS. Notwithstanding any other provision of this Agreement, the Company shall promptly pay or reimburse expenses incurred by Director in connection with his appearance as a witness or other participation in a proceeding at a time when he is not a named defendant or respondent in the proceeding.

Except as otherwise provided herein, all Parties to this Agreement and those Market Participants that agree to accept the benefits of this Settlement shall remain free to participate, without limitation, in any existing proceeding with respect to parties other than Reliant, or to initiate or participate in any future proceeding to the extent not inconsistent with the releases set forth in Sections 8.2, 8.3, 8.4, 8.5 and 8.6, including proceedings addressing, prospectively, generic issues concerning market structure, scheduling rules, generally applicable market rules, and generally applicable price mitigation.
PARTICIPATION IN OTHER PROCEEDINGS. Notwithstanding other terms of this agreement, Covad may participate and/or continue its participation in proceedings involving material industry- wide issues and issues that have industry-wide applicability that do not involve allegations or claims directly between Covad and SBC before the FCC and state public utility commissions and in the performance measurement proceedings in California, Nevada and Texas; and SBC may participate and/or continue its participation in any proceedings involving such industry-wide material issues, any generic proceedings and any proceedings involving other parties, including without limitation regulatory proceedings in which Covad may be a party that will be subject to dismissal as to Covad under this Agreement, like the Covad/Rhythms arbitration in Illinois.

At City's request, Contractor shall allow itself to be joined as a party in any legal proceeding that involves City regarding the design, construction, installation, operation, or maintenance of any Project that is the subject of this Contract. This provision is for the benefit of City and not for the benefit of any other party.
