Other Terms of This Agreement. (a) In entering into this Agreement, I am not relying on any oral or written representations other than as set forth in this Agreement.
(b) This Agreement shall be governed by and construed pursuant to the laws of the Province or Territory in which the Agency is located.
(c) In the event that any provision or term of this Agreement is held to be invalid, illegal or unnforceable, the remaining provisions of this Agreement shall remain in full force and effect.
Other Terms of This Agreement. This Agreement shall be effective and binding on my personal representatives, estate, heirs, next of kin, executors, administrators and assigns, in the event of my death or incapacity.
Other Terms of This Agreement. Disclaimer: LLM shall not be responsible for theft, loss or damage to any items left on OWNER’s boat during launch, storage or haul-out. OWNER shall fully advise LLM of any unusual or atypical underwater fittings, hull or engine configuration, instruments above and below the rail, or other conditions of the boat that could require other than the standard procedures for launch, storage, or haul out. LLM shall not be responsible for any damage to OWNER’s boat resulting from the OWNER’s failure to so advise, or in any way due to said unusual or atypical fittings or configurations below the waterline.

c. In the event that any provision or term of this Agreement is held to be invalid, illegal or unenforceable, the remaining provisions of this Agreement shall remain in full force and effect.
Other Terms of This Agreement. 4.1 All possible disputes that may arise from this Agreement or related to it are subject to resolution in accordance with the current legislation of Ukraine.
4.2. The text of this Agreement must not be understood as the establishment between the User and the Site Administration of agency relations, community relations, joint activity relations, personal labor relations or any other relations not expressly provided for by the Agreement.
4.3. The recognition by the court of any provision of the Agreement as invalid or not subject to enforceability does not entail invalidation of the other provisions of the Agreement.
4.4. Inaction on the part of the Website Administration in case of violation by any of the Users of the provisions of the Agreement does not deprive the Site Administration of the right to take appropriate actions to protect their interests and protect the copyright of the site materials protected in accordance with the law at any time.
4.5. The Agreement is legally binding, in accordance with Art. 633, 641, 642 of the Civil Code of Ukraine and is equivalent to an agreement signed by both Parties.
Other Terms of This Agreement. 1. By this Agreement, the Donor delivers and the University accepts all right, title and interest to, and possession of the Property.
2. The Donor acknowledges and agrees that the donation of the Property is unconditional and irrevocable, and by this Agreement surrenders all right to reclaim ownership or possession of the Property.
3. The Donor covenants and agrees that to the best of the Donor’s knowledge, the Property is not subject to the interests of any other persons, and the receipt and possession of the Property by the University does not constitute a violation of the laws of any jurisdiction of Canada or elsewhere, of any aboriginal rights, or of any agreement, written or verbal, in relation to the Property.
4. The Donor hereby covenants and agrees to indemnify and save harmless the University from any claims which may arise in relation to the Property resulting from interests of other parties in and to the Property, of which the Donor was or ought to have been aware, and did not disclose to the University at the time of execution of this Agreement.
5. The University reserves the right to refuse to issue an income tax receipt for the value of the Property an amount greater than that which the University, in its sole discretion, deems to be reasonable.
Other Terms of This Agreement. By July 1, 2004, BRWM and DWP agree to designate contact persons to receive information, inquiries, and assistance requests related to this MOA.
Other Terms of This Agreement. The parties acknowledge that the Concessionaire has been furnished with instructions for the Concession Agreement, which the parties agree are additional terms of this Agreement. This Agreement and the Instructions for Concession Agreement forms the entire agreement between the parties. This Agreement shall not be modified, discharged, or extended except by a writing executed by the Commission and Concessionaire. The parties agree that no representations or warranties shall be binding upon the Commission or Concessionaire unless expressed in writing in this Agreement, the Instructions for Concession Agreement, or amendments thereto.
