PAYMENT OF BACK PAY CLAIMS. If the Company fails to give an employee work to which the employee's seniority entitles the employee, and a written notice of the employee's claim is filed within ten (10) working days of the time the Company first failed to give the employee such work, the Company will reimburse the employee for the earnings lost through failure to give the employee such work.

If the Employer fails to give an employee pay to which he/she was entitled, and a written notice of his/her claim is filed within sixty (60) days of the time the Employer first failed to give him/her such pay, the Employer will reimburse him/her for the earnings he/she lost through such failure. If the Employer fails to give an Employee pay to which he/she was entitled as the result of an error by the Employer, the Employer shall make the employee whole for monies lost. A written notice of the claim in this circumstance must be filed within one year of the time the Employer failed to give him/her such pay. In all other cases, the sixty (60) day time period shall apply.
