Common use of Percentage in Lieu of Benefits Clause in Contracts

Percentage in Lieu of Benefits. Part-time employees (except as stated in the Grandparented Letter of Understanding) will receive percentage in lieu of all health and welfare benefits, holiday pay, and sick leave. Where the employee does not participate in the pension plan the amount of the percentage in lieu shall be 13%. Where the employee does participate in the pension plan, the percentage in lieu shall be reduced by an amount equal to the employers’ contribution to the pension plan and the amount of percentage in lieu will continue to conform to the Employment Standards Act.
