Retirement in Lieu of Layoff. Any employee who was subject to being, or was in fact, laid off and who is qualified for and who elected service retirement from the Public Employees’ Retirement System shall be placed on an appropriate reemployment list. The District shall notify the Board of Administration of the Public Employees’ Retirement System of the fact that retirement was due to layoff. If he/she is subsequently subject to reemployment and accepts, in writing, the appropriate vacant position, the District shall maintain the vacancy, but may fill it on a temporary basis until the Board of Administration of the Public Employees’ Retirement System has properly processed his/her request for reinstatement from retirement.
Retirement in Lieu of Layoff. Any classified employee eligible for retirement may elect to accept service retirement in lieu of layoff without loss of re-employment rights as provided in this Agreement, provided written notification is given to the Employer of such election. (Education Code Section 45115)
Retirement in Lieu of Layoff. A worker who is eligible for retirement and who has received a notice of layoff may, in lieu of layoff, elect to accept service retirement without loss of reemployment rights as provided in the Education Code Section 88015.
Retirement in Lieu of Layoff. Any employee eligible for a service retirement under Public Employee Retirement System may elect to accept a service retirement in lieu of layoff, voluntary demotion or reduction in assigned time. Such employee shall not less than ten (10) days prior to the effective date of the proposed layoff provide written notification to the District to the effect. The District shall assist the employee in effecting retirement through the Public Employee Retirement System. The employee shall then be placed on a thirty- nine (39) month reemployment list as would any laid off employee. However, the employee's eligibility for reemployment shall be governed by the applicable statues within the Government Code, and the Regulations of the Public Employees Retirement System. The District agrees that when an eligible retiree responds positively and in a timely fashion to an offer of reemployment, the retiree shall be granted the time necessary for terminating retired status and returning to active service. An eligible retiree who declines to accept an offer of reemployment to a position equal in class and hours to that from which retired shall be removed from the reemployment list and thereafter be considered permanently retired. Any election to accept service retirement after being placed on a reemployment list shall be considered retirement in lieu of layoff under this Section.
Retirement in Lieu of Layoff. 9.9.1 Any member in the bargaining unit may elect to accept a service retirement in lieu of layoff, voluntary demotion, or reduction in assigned time. Such bargaining unit member shall, within ten

If an employee subsequently accepts, in writing, an appropriate vacant position within the period of 39 months, the District shall maintain the position until PERS has processed the request for reinstatement from retirement.
Retirement in Lieu of Layoff. Any employee in the bargaining unit may elect to accept a service retirement in lieu of layoff, voluntary demotion, or reduction in assigned time. Such employee shall within ten (10) workdays prior to the effective date of proposed layoff file a request with the District. The employee shall then be placed on a thirty-nine (39) month re-employment list in accordance with Section 17.7 of this Article; however, the employee shall not be eligible for re-employment during such other period of time as may be specified by pertinent Government Code sections. The District agrees that when an offer of re-employment is made to an eligible person retired under this Article, and the District receives within ten (10) working days a written acceptance of the offer, the position shall not be filled by any other person, and the retired person shall be allowed sufficient time to terminate his/her retired status. An employee subject to this Section who retires and is eligible for re-employment and who declines an offer of re-employment equal to that from which laid off shall be deemed to be permanently retired. Any election to retire after being placed on a re-employment list shall be retirement in lieu of layoff within the meaning of this section.
Retirement in Lieu of Layoff. A Unit Member may elect to accept a service retirement in lieu of layoff, voluntary demotion, or reduction in assigned time. Such Unit Member shall within ten (10) working days prior to the effective date of the proposed layoff complete and submit a form provided by the District for this purpose. The Unit Member shall be placed on the appropriate reemployment list. The District shall notify the Board of Administration of the Public Employee’s Retirement System (PERS) of the fact that retirement was due to layoff. If the Unit Member is subsequently subject to reemployment and accepts, in writing, the appropriate vacant position, the District shall maintain the vacancy, but may fill it on a temporary basis, until the Board of Administration of PERS has properly processed the request for reinstatement from retirement.
Retirement in Lieu of Layoff. 18.7.1 Any employee subject to being laid off or who was in fact laid off may elect to accept a service retirement from the Public Employee’s Retirement System in accordance with Education Code Section 88015.
18.7.2 The employee shall be placed on a thirty-nine (39) month reemployment list in accordance with of this Article; however, the employee shall not be eligible for reemployment during such other period of time as may be specified by pertinent Government Code Sections.
18.7.3 The District agrees that when an offer of reemployment is made to an eligible person retired under this Article, and the District receives within ten (10) working days a written acceptance offer, the position shall not be filled by any other person, and the retired person shall be allowed sufficient time to terminate his/her retired status.
18.7.4 An employee subject to this Article who retires and is eligible for reemployment and who declines an offer of reemployment equal to that from which laid off shall be deemed to be permanently retired.
18.7.5 Any election to retire after being placed on a reemployment list shall be retired in lieu of layoff within the meaning of this Article.
Retirement in Lieu of Layoff. 15 Any employee in the bargaining unit may elect to accept a service retirement in lieu of layoff, 16 voluntary demotion or reduction in assigned time. Such employee shall, within ten (10) work 17 days prior to the effective date of the proposed lay-off, complete and submit a form provided 18 by the District for this purpose.
