Performance During Disputes. It is mutually agreed that during any kind of controversy, claim, disagreement or dispute, including a dispute as to the validity of this Agreement, Manager shall remain in possession of the Hotel as Manager; and Owner and Manager shall continue their performance of the provisions of this Agreement and its exhibits. Manager shall be entitled to injunctive relief from a civil court or other competent authority to maintain possession in the event of a threatened eviction during any dispute, controversy, claim or disagreement arising out of this Agreement.
Performance During Disputes. Unless otherwise directed by SEPTA, Contractor shall continue to perform under the Agreement while matters in dispute are being resolved.
Performance During Disputes. Pending resolution of any Dispute between the Parties, the Parties shall continue to perform in good faith their respective obligations under this Agreement based upon the last agreed performance demonstrated prior to the Dispute.
Performance During Disputes. Unless termination of this Agreement has been declared, Management Company shall be under the obligation to continue to perform its obligations under this Agreement while the parties seek to resolve any dispute.
Performance During Disputes. The parties mutually agree that during any kind of controversy, claim, disagreement or dispute, including, without limitation, a dispute as to the validity of this Development Agreement, the Authority and Developer shall continue their performance of the provisions of this Development Agreement for a period of forty-five (45) days, provided funds necessary to pay Project costs which continue to be incurred (other than amounts in dispute) continue to be available.

Operator shall be entitled to injunctive relief from a civil court or other competent authority to maintain possession in the event of a threatened eviction during any dispute, controversy, claim or disagreement arising out of this Agreement.
Performance During Disputes. It is mutually agreed that during any kind of controversy, claim, disagreement or dispute, including a dispute as to the validity of this Agreement, Manager shall continue to possess the rights, duties, and obligations set forth in this Agreement, and the Authority and Manager shall continue their performance of the provisions of this Agreement and its exhibits. Manager and the Authority agree that the Enterprise Bank Accounts shall not be subject to attachment or any rights of deduction or set off or counterclaim by either party. Manager and the Authority shall each be entitled to injunctive relief from a civil court or other competent authority to maintain such rights, duties, and obligations in the event of a threatened eviction during any dispute, controversy, claim or disagreement arising out of this Agreement. Notwithstanding any provision in this Section 18.6 to the contrary, if the dispute involves the revocation of Manager’s license, Manager will suspend performance of its managerial duties under this Agreement; however, the Enterprise will continue to pay the Management Fee into an off-reservation third party interest-bearing escrow account until such time that the dispute is resolved.
Performance During Disputes. Except where an Arbitrator or the NIGC concludes that operation by MPM would violate applicable law or endanger the integrity of gaming, it is mutually agreed that during any kind of controversy, claim disagreement or dispute, including a dispute as to the validity of this Agreement, MPM shall continue to possess the rights, duties, and obligations set forth in this Agreement, and MBPI, the Authority and MPM shall continue their performance of the provisions of this Agreement and its exhibits; provided, however, that MPM’s right of access to and presence in the Facility shall cease upon any revocation of the Manager’s gaming license, except that MPM shall have the temporary right to access the Facility and the Property for the limited purpose of recovering its books, records and personal property. MPM shall and MBPI agree that the Enterprise Bank Accounts shall not be subject to attachment or rights of deduction or set off or counterclaim by either party. MPM and MBPI and the Authority shall each be entitled to injunctive relief from a civil court or other competent authority to maintain such rights, duties, and obligations in the event of a threatened eviction during any dispute, controversy, claim or disagreement arising out of this Agreement.
Performance During Disputes. Each party shall continue to perform its obligations under this Agreement pending the final resolution of any Dispute arising out of or relating to this Agreement, unless such continued performance would be commercially impossible or impracticable.
Performance During Disputes. DAOU shall be under the obligation to continue to provide Services to the Client while the parties are seeking to resolve any Dispute so long as the Client shall continue to pay DAOU all Service Fees, both past due and as they come due, with or without Client's reservation of rights.
