Notwithstanding anything to the contrary contained in this Lease, in the event Tenant fails to maintain insurance required pursuant to Article 6 of this Lease, Landlord shall have the right to obtain such insurance on behalf of Tenant and Tenant shall reimburse Landlord, as additional Rent, within five (5) days of receipt of notice of the procurement of such insurance.

Performance for Tenant. After the occurrence of an Event of Default, Landlord shall have the right, without waiving or releasing Tenant from any of its obligations, to make any payment or perform any other obligation on Tenant's behalf and at Tenant's expense. If Landlord cures an Event of Default on behalf of Tenant, Tenant shall reimburse Landlord for all costs incurred in connection with such cure, including without limitation reasonable attorneys' fees and costs, within ten days after receipt of Landlord's invoice.

All sums so paid by Landlord and all necessary incidental costs together with interest thereon at the Interest Rate set forth in Subparagraph l(w), from the date of such payment by Landlord, shall be payable to Landlord on demand. Tenant covenants to pay any such sums, and Landlord shall have (in addition to any other right or remedy of Landlord) all rights and remedies in the event of the non-payment thereof by Tenant as are set forth in this Paragraph 23.

  • Performance Goals A. The Trust and State Street have developed mutually acceptable performance goals dated March 1, 2011 , and as may be amended from time to time, regarding the manner in which they expect to deliver and receive the services under this Agreement (hereinafter referred to as “Service Level Agreement”). The parties agree that such Service Level Agreement reflects performance goals and any failure to perform in accordance with the provisions thereof shall not be considered a breach of contract that gives rise to contractual or other remedies. It is the intention of the parties that the sole remedy for failure to perform in accordance with the provisions of the Service Level Agreement, or any dispute relating to performance goals set forth in the Service Level Agreement, will be a meeting of the parties to resolve the failure pursuant to the consultation procedure described in Sections V.   • Performance Measures The System Agency will monitor the Grantee’s performance of the requirements in Attachment A and compliance with the Contract’s terms and conditions.
