Period of Continuous Service Period of Notice 1 year or less and up to the completion of 3 years 2 weeks 3 years and up to completion of 5 years 3 weeks 5 years and over 4 weeks In addition to the period referred to above, an employee over 45 years of age at the time of the giving of the notice with not less than two years continuous service, will be entitled to an additional weeks notice.

Where the employer gives notice, it shall be in writing and payment may be made in lieu. The employer may dismiss the employee without notice for serious misconduct. During any probationary period i.e. three months, the employee’s employment may be terminated on the giving of one weeks notice or payment in lieu. A casual employee may be dismissed on one hours notice. The period of notice shall not apply in the case of dismissal for conduct that justified instant dismissal or in case of casual employees or employees engaged for a specific period of time or specific task(s). Payment in lieu of the notice period will be calculated on the ordinary time earnings and will not take into account any allowances or other benefits that to which the Employee may otherwise be entitled.

  • Death or Disability The Executive's employment shall terminate automatically upon the Executive's death during the Employment Period. If the Company determines in good faith that the Disability of the Executive has occurred during the Employment Period (pursuant to the definition of Disability set forth below), it may give to the Executive written notice in accordance with Section 12(b) of this Agreement of its intention to terminate the Executive's employment. In such event, the Executive's employment with the Company shall terminate effective on the 30th day after receipt of such notice by the Executive (the "Disability Effective Date"), provided that, within the 30 days after such receipt, the Executive shall not have returned to full-time performance of the Executive's duties. For purposes of this Agreement, "Disability" shall mean the absence of the Executive from the Executive's duties with the Company on a full-time basis for 180 consecutive business days as a result of incapacity due to mental or physical illness which is determined to be total and permanent by a physician selected by the Company or its insurers and acceptable to the Executive or the Executive's legal representative.

  • Continuous Employment For purposes of this Agreement, the continuous employment of the Grantee with the Company or a Subsidiary shall not be deemed to have been interrupted, and the Grantee shall not be deemed to have ceased to be an employee of the Company or Subsidiary, by reason of (a) the transfer of the Grantee’s employment among the Company and its Subsidiaries or (b) an approved leave of absence.
