Permanent Positions. (a) The successful bidder for a permanent position shall be assigned to his new job no later than nine (9) months after the job is awarded. If, because of lack of a qualified replacement or other causes, there is a further delay to the job assignment, the matter shall be discussed with the Chief Xxxxxxx. The Company will endeavor to fill the position as quickly as reasonably possible. If the position is a promotion, the successful bidder will receive full pay and seniority of the new position from the day the award is posted. (b) All permanent full-time vacancies, all new jobs, all premium jobs, all promotions and all jobs at newly opened stations within the scope of this Agreement shall be bulletined within five (5) days of the requirement for a position, for a period of ten (10) work days at all locations where employees hereunder are employed. Such bulletin shall state the vacancy or vacancies or jobs are or permanent, the number of jobs to be filled, the classification of each job, the station or location. The vacancy or vacancies will be bulletined system-wide at all shops and stations giving all the information required above and shall specify a final date after which bids will not be considered. Such date will not be less than ten (10) days after the bulletin is posted. An employee, who is on vacation or training for the entire ten (10) day period or longer, may file a bid within forty-eight (48) hours of returning to duty. (c) An employee bidding for more than one (1) vacancy shall indicate the order of preference on each bid, and if he is the senior bidder on more than one (1) vacancy, he shall have the opportunity to qualify only for the job ranked highest in his preference. All bids will be made in three (3) written copies by the employee with two (2) copies furnished to the Company and one (1) copy furnished to the General Chairman. (d) After an employee has been chosen to fill a bulletined job, the Company shall within five (5) work days post a notice of same on all appropriate bulletin boards and furnish a copy to the General Chairman, showing the name of the successful bidder and his classification seniority date. An employee, whose name is posted as the successful bidder to fill bulletined vacancies and who subsequently rescinds his bid, shall be prohibited from bidding for all subsequent vacancies for a period of three (3) months. A successful bidder for a vacancy will be permitted to bid for other vacancies without penalty up to his last active working day at his present station. In the event that there is no applicant for a vacancy, an employee who is presently prohibited from bidding under this paragraph, will be allowed to file a late bid for the vacancy in accordance with seniority. (e) In the case of a successful bidder for a permanent bulletined job, all expenses incident to the transfer shall be borne by the employee unless the job fails to continue for at least six (6) months, in which case the moving expense allowance, in accordance with the provisions of Article VIII paragraph (e), excluding the resettlement allowance, will be allowed. (f) In filling all permanent Maintenance Representative, the senior Maintenance Representative bidding will be chosen. In the event the senior bidder does not have the required licenses, he will be given the opportunity to obtain same. (g) Mechanic Promoted to Maintenance Representative If no Maintenance Representatives bid for or accept the position, the senior Mechanic who bids for, is qualified and has the ability to perform the duties required for the job, shall be awarded the position. The successful bidder must obtain the required licenses as per [Training Article Proposal]. The successful bidder shall hold the bulletined job for a period of ninety (90) consecutive days (to commence upon successfully obtaining the first B1 approval) on a trial basis in order to demonstrate his ability to perform the work required by the job, provided the trial period does not exceed six (6) months after the commencement of work in the classification. During such period, if the employee is unable to demonstrate his ability to perform the work required by the job, or if he finds the job to be not as represented in the bulletin, he may return to his previous assignment, but he shall not, in case of failure to demonstrate ability, for a period of six (6) months after said failure, be permitted to bid for a vacancy in the higher classification in the same type of work in which he was unable to demonstrate ability. (h) In filling all other permanent bulletined jobs covered by this Agreement, the senior employee bidding will be chosen. (i) During the interim required to bulletin a vacancy, if not expected to last less than sixty (60) days, paragraph (b) Temporary Union Positions, will apply.

(d) After filling of an employee has been chosen to fill a bulletined job, the Company shall within five (5) work days post a notice of same on all appropriate bulletin boards and furnish a copy to the General Chairman, showing the name of the successful bidder and his classification seniority date. An employee, whose name is initial permanent vacancy will be posted as the successful bidder to fill bulletined vacancies and who subsequently rescinds his bid, shall be prohibited from bidding for all subsequent vacancies for a period of three (3) monthsconsecutive working days, excluding Saturdays, Sundays and Holidays. A Applications for such vacancies shall be made in writing within the three (3) working day period referred to herein. In matters of promotion and staff transfer appointment shall be made of the senior applicant able to meet the normal requirements of the job. If an employee is required to attend an interview during regularly scheduled working hours, the employee shall suffer no loss of earnings from regularly scheduled hours as a result of attending the interview. The name of the successful bidder applicant will be posted on the bulletin board for a vacancy period of seven (7) calendar days. Wherever possible, the Hospital will endeavour to start the successful applicant in the position not later than thirty (30) days following his/her selection. Where there are no successful applicants from within this bargaining unit for vacant positions referred to in this Article, employees in other OPSEU bargaining units at the Hospital will be permitted to bid for other vacancies without penalty up to his last active working day at his present station. In the event that there is no applicant for a vacancy, an employee who is presently prohibited from bidding under this paragraph, will be allowed to file a late bid for the vacancy in accordance with seniority.
(e) In the case of a successful bidder for a permanent bulletined job, all expenses incident to the transfer shall be borne by the employee unless the job fails to continue for at least six (6) months, in which case the moving expense allowance, selected in accordance with the provisions criteria for selection above, and prior to considering persons who are not members of Article VIII paragraph (e), excluding OPSEU bargaining units at the resettlement allowance, will Hospital. If there are no applicants with the necessary ability, the Employer reserves the right to re-state the duties of the position and then re-post the position after it has been re-evaluated. The Employer shall fill job vacancies from within the Company before hiring a new employee, providing suitable employees are available to fill the vacant position. In the event there are no applicants for a position posted for competitive selection with the senior bidder does not have the required licenses, he will be given the opportunity to obtain same.

Permanent Positions. (At the time of providing notice of layoff and throughout the notice period, the Employer shall identify any vacant positions within the bargaining unit. Employees receiving notice of layoff shall be offered, in order of seniority, direct assignment into any such vacant positions that is within 40km of the employee’s permanent work location, in classifications for which the maximum salary is no more than 5% above or no more than 15% below the maximum salary of the classification of the position from which the employee is being laid off and which they are qualified to perform the duties of the vacant position. Employees eligible for direct assignment may elect either at the time of the notice of layoff or at any time thereafter in the notice period to modify the geographic and/or salary parameters set out above, and accept direct assignment to:
a) any other work location beyond 40km; or
b) for positions with a salary maximum of more than 15% less than their position, or c) both a) and b); in which case the Employer shall also offer such direct assignments for which they are qualified to perform the duties of the vacant position, in order of seniority. The successful bidder for a permanent position employee shall indicate in writing to the employer the geographic locations beyond 40km where the employee is willing to work and the lower salary maxima. No vacancy shall be posted until it has been determined that no employee is eligible to be directly assigned to his new job no later than nine (9) months after under this Article. In the event that there more than one employee is no applicant for receiving a vacancynotice of layoff, an the most senior employee who is presently prohibited from bidding under this paragraphreceiving a notice shall be offered a list of direct assignments first, and following their election, the remaining direct assignments will be allowed to file a late bid for the vacancy in accordance with seniority.
(e) In the case of a successful bidder for a permanent bulletined job, all expenses incident offered to the transfer shall be borne by the employee unless the job fails to next most senior employee. This process will continue for at least six (6) months, in which case the moving expense allowance, in accordance with the provisions declining order of Article VIII paragraph (e), excluding the resettlement allowance, seniority until no more direct assignments are available. No displacement offers will be allowed.
(f) In filling all permanent Maintenance Representative, the senior Maintenance Representative bidding will be chosenmade until this process is exhausted and there are no more direct assignment offers remaining. In the event that an employee declines the senior bidder does offer of a direct assignment, the employee shall not be offered any more direct assignments, will not receive a displacement option and will also have waived their right to recall. The employee will have the required licenses, he will be given option of either working out the opportunity to obtain same.
(g) Mechanic Promoted to Maintenance Representative If no Maintenance Representatives bid notice period or accepting their remaining pay in lieu option. Where employees are available for or accept the positiondirect assignment, the senior Mechanic who bids for, is qualified and has Employer shall provide AMAPCEO with a list of vacant bargaining unit positions when a vacant position becomes available. Following the ability to perform exhaustion of the duties required for initial round of the job, shall be awarded the position. The successful bidder must obtain the required licenses as per [Training Article Proposal]. The successful bidder shall hold the bulletined job for a period of ninety (90) consecutive days (to commence upon successfully obtaining the first B1 approval) on a trial basis in order to demonstrate his ability to perform the work required by the job, provided the trial period does not exceed six (6) months after the commencement of work in the classification. During such period, if the employee is unable to demonstrate his ability to perform the work required by the job, or if he finds the job to be not as represented in the bulletin, he may return to his previous assignment, but he shall not, in case of failure to demonstrate ability, for a period of six (6) months after said failure, be permitted to bid for a vacancy in the higher classification in the same type of work in which he was unable to demonstrate ability.
