Personal Information Breach Notification. Xxxxxx Mind will, without undue delay, notify the Institution of any Personal Information Breach. Xxxxxx Mind will provide commercially reasonable assistance to the Institution for the Institution’s fulfilment of its legal obligations related to a Personal Information Breach. Initial notification(s) of Personal Information Breaches, if any, will be delivered to Xxxxxx Mind's existing business contact at the Institution by means as agreed to by the Parties. It is the Institution’s sole responsibility to ensure it maintains accurate contact information for purposes of such notification. Xxxxxx Mind shall not make any notification to any regulatory, supervisory or government body, or to any data subject about the Personal Information Breach without the Institution's prior written consent.

Personal Information Breach Notification. Splunk will notify Customer without undue delay after becoming aware of a Personal Information Breach. Where appropriate in respect of any Personal Information which has been the subject of a Personal Information Breach, Splunk will provide reasonable assistance to Customer to the extent required for Customer to comply with Data Protection Law, which may include assistance in notifying Consumers and the relevant regulatory authority, providing a description of the Personal Information Breach, including where possible: (a) the nature of the Personal Information Breach and the categories and approximate number of Consumers and/or Personal Information records concerned; (b) the name and contact details of Splunk’s data protection officer or other contact point; (c) a description of (i) the likely consequences of the Personal Information Breach and (ii) measures to mitigate its possible adverse effects. If it is not possible to provide the above information simultaneously, additional information will be provided without undue delay as it becomes available.
Personal Information Breach Notification. Aconex shall promptly notify Client if Aconex becomes aware of and determines that a breach of secu- rity leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or ac- cess to, Personal Information transmitted, stored or otherwise processed under the Agreement has oc- curred that compromises the security, confidentiality or integrity of such Personal Information Pro- cessed by within Aconex’s scope of responsibility (“Personal Information Breach”). Aconex will provide Client with (i) a description of the nature and reasonably anticipated consequences of the Personal In- formation Breach; (ii) the measures taken to mitigate any possible adverse effects and prevent a recur- rence; (iii) where possible, the categories of Personal Information and Data Subjects including an ap- proximate number of Personal Information records and Data Subjects that were the subject of the Per- xxxxx Information Breach; and (iv) other information concerning the Personal Information Breach rea- sonably known or available to Aconex that Client may be required to disclose to a Supervisory Author- ity or affected Data Subject(s). Aconex shall implement reasonable measures designed to mitigate potential adverse consequences of the Personal Information Breach. Within the timeframes required for Client to meet its Personal Data Breach notification obligations under Applicable Data Protection Law, Client agrees to coordinate with Aconex in good faith on the content of Client’s intended public statements or required notices for the affected Data Subjects and/or notices to the relevant Supervisory Authorities regarding the Personal Information Breach.
