Personal Information security breach. Supplier/Service Provider’s Obligations
a) The Supplier/Service Provider shall notify the Information Officer of Transnet, in writing as soon as possible after it becomes aware of or suspects any loss, unauthorised access or unlawful use of any personal data and shall, at its own cost, take all necessary remedial steps to mitigate the extent of the loss or compromise of personal data and to restore the integrity of the affected Goods/Services as quickly as is possible. The Supplier/Service Provider shall also be required to provide Transnet with details of the persons affected by the compromise and the nature and extent of the compromise, including details of the identity of the unauthorised person who may have accessed or acquired the personal data.
b) The Supplier/Service Provider shall provide on-going updates on its progress in resolving the compromise at reasonable intervals until such time as the compromise is resolved.
c) Where required, the Supplier/Service Provider may be required to notify the South African Police Service; and/or the State Security Agency and where applicable, the relevant regulator and/or the affected persons of the security breach. Any such notification shall always include sufficient information to allow the persons to take protective measures against the potential consequences of the compromise.
d) The Supplier/Service Provider undertakes to co‑operate in any investigation relating to security which is carried out by or on behalf of Transnet including providing any information or material in its possession or control and implementing new security measures.

The Receiving Party shall notify the Information Officer of the Disclosing Party, in writing as soon as possible after it becomes aware of or suspects any loss, unauthorised access or unlawful use of any Personal Information and shall, at its own cost, take all necessary remedial steps to mitigate the extent of the loss or compromise of Personal Information and to restore the integrity of the affected Service(s) as quickly as is possible. The Receiving Party shall also be required to provide the Disclosing Party with details of the Data Subjects who are affected by the compromise and the nature and extent of the compromise, including details of the identity of the unauthorised person who may have accessed or acquired the Personal Information.
26.3.2. The Parties shall provide ongoing updates on its progress in resolving the compromise at reasonable intervals until such time as the compromise is resolved.
26.3.3. Where required by law, the Parties may be required to notify the South African Police Service; and/or the State Security Agency and where applicable, the relevant regulator and/or the affected Data Subjects of the security breach. Any such notification shall always include sufficient information to allow the Data Subjects to take protective measures against the potential consequences of the compromise.
26.3.4. Each Party undertakes to co-operate in any investigation relating to security which is carried out by or on behalf of the other Party including providing any information or material in its possession or control and implementing new security measures
Personal Information security breach. 7.1 The Operator shall notify the Responsible Party immediately when the Operator becomes aware of or suspects any loss, unauthorised access or unlawful use of any Personal Information and shall, at its own cost, take all necessary remedial steps to mitigate the extent of the loss or compromise and to restore the integrity of the affected information.
7.2 The Operator shall also be required toprovide the Responsible Party with details of the Personal Information Subjects who are affected by the security breach and the nature and extent of the breach, including details of the identityof the unauthorised Person(s) who may have accessed or acquired the Personal Information.
7.3 The Operator shall comply with the breach notification requirements as set out in section 22 of POPIA.

Personal Information security breach an unauthorized access and exfiltration, theft, or disclosure as a result of Our violation of the duty to implement and maintain reasonable security procedures and practices appropriate to the nature of the information to protect the personal information, as described in subdivision (a)(1) of Cal. Civ. Code §1798.150
