Phase I Report. Within thirty (30) days prior to the expiration or sooner termination of the Term, Tenant, at its expense, shall cause a so-called "Phase I" environmental inspection to be performed and a report in respect thereof to be prepared and delivered to both Landlord and Tenant to determine whether any Cleanup Activity is required, Landlord and Tenant agreeing that the responsibility for the Cleanup Activity shall be determined by the preceding provisions of this Section.
Phase I Report. The Administrative Agent shall have received a phase-I environmental report with respect to each parcel composing the owned Real Property located in New Jersey (the environmental consultants retained for such reports, the scope of the reports, and the results thereof of which shall be reasonably satisfactory to Administrative Agent).
Phase I Report. A copy of the final Phase I Report together with a reliance letter from the issuer of the Phase I Report, in form and substance satisfactory to the Collateral Agent, authorizing the Administrative Agent, the Collateral Agent and the Lenders to rely on such Phase I Report to the same extent as if it had been addressed directly to and prepared on behalf of such parties.

Phase I Report. For the thirty-day period beginning on the date hereof, Seller shall cooperate with Buyer so that Buyer can promptly obtain (at Buyer's expense) a Phase I Environmental Site Assessment Report prepared consistent with ASTM Standard 1527-00 concerning the Leased Premises from an environmental engineering firm acceptable to Buyer that shall confirm, in a manner reasonably satisfactory to Buyer, the non-existence of any Hazardous Materials on or about the Leased Premises or any violation of Environmental Laws. Any audit report beyond a Phase I Report shall be conducted by Buyer only with the prior written consent of Seller.
Phase I Report. All information provided by Raven Holdings, the Operating Company and their Affiliates, officers and employees to Xxxx International, Inc. in connection with Xxxx International, Inc.’s preparation of a Phase I Environmental Site Assessment and Environmental Audit regarding the Business is true, accurate and complete and is not misleading in all material respects.

Phase I Report. In Section 4.1 of the Lease, “August 15, 2006” is hereby replaced with “August 31, 2006”.
