Planning Agreement. This Agreement is a planning agreement within the meaning of section 7.4(1) of the Act.
Planning Agreement. This document is a planning agreement:
(1) within the meaning set out in s7.4 of the Act; and
(2) governed by Subdivision 2 of Division 7 of the Act.
Planning Agreement. This Agreement is a planning agreement within the meaning of section 93F(1) of the Act.
Planning Agreement. 3.1 This agreement
3.1.1 applies to the Development Land;
3.1.2 is a planning agreement within the meaning set out in section 93F of the Act;
3.1.3 is to be registered on the title of the Development Land under section 93H of the Act;
3.1.4 is not a confidential document and may be exhibited without restriction by either party.
3.2 Subject to clause 3.3, this agreement operates from the date it is executed.
3.3 Clause 6 of this agreement will only operate if and when Council grants Development Approval (or Development Approvals as the case may be) to the Proposed Development on the Development Land.
Planning Agreement. (a) The parties agree that this Agreement is made as a Planning Agreement pursuant to section 7.4 of the Act and goes beyond this with the significant public benefit of the Development.
(b) Annexure A of this Agreement, being the Explanatory Note, summarises the requirements for planning agreements under section 7.4 of the Act and the way this Agreement addresses those requirements.
(c) The parties acknowledge and agree that, in accordance with section 4.15 of the Act, the terms of this Agreement must be considered by any consent authority when determining a Development Application for the Development, or any part of the Development.
Planning Agreement. Subject to Section 10.24, subsequent to the Effective Date, the respective Purchaser planning group and the appropriate Manufacturer designee shall mutually agree upon best practices and the general standards of conduct expected of the Parties in connection with this Agreement to ensure that customer requirements are met (a “New Planning Agreement”). To the extent that as of the Effective Date any agreement is in effect with respect to the best practices and the general standard of conduct to be utilized with respect to the Manufacture and delivery of Product (an “Existing Planning Agreement”, a copy of which is attached hereto as Exhibit 2.7), the Parties shall adopt the terms of such Planning Agreement and shall discuss and mutually agree on any changes to such Existing Planning Agreement to ensure that customer requirements are met. In the event of any inconsistency between the terms of any Planning Agreement and the terms of this Agreement, the terms of this Agreement shall prevail.
Planning Agreement. The Planning Agreement operates from the date on which the later of the following occurs:
(1) it is entered into in accordance with the EPA Act and the Regulations; and
(2) the Instrument Change is made.

(1) within the meaning set out in s93F of the EPA Act; and
(2) governed by Subdivision 2 of Division 6 of Part 4 of the EPA Act.
Planning Agreement. Council and the Development Parties agree that this Agreement is made as a Planning Agreement pursuant to section 93F of the Act.
