Point of Sale System. At its sole expense, Franchisee shall purchase a Point of Sale System as specified in writing from Franchisor or otherwise approved by Franchisor provided it complies with Franchisor’s specifications and standards. Franchisee shall allow the transmission of any and all information from the Franchisee to the Franchisor using this system. Franchisee shall record all sales and all receipts of the Xxxxx revenue on individual point of sale generated serial-numbered receipts.

Point of Sale System a. The Franchisee shall purchase from the Franchisor’s approved supplier such point of sale and business management software licences as is approved in writing by the Franchisor. b. The aforementioned point of sale and software shall to be used by the Franchisee at all times in the operation of the Business.
Point of Sale System. All sales and transactions made from the Premises shall be recorded by means of cash registers or other comparable devices to be approved by the Harbor Manager, which display to the customer the amount of the transaction and automatically issue a receipt for every transaction. The registers shall be equipped with devices which lock in sales totals and other transaction records, and with counters which are not re-settable and which record transaction numbers and sales details. Totals registered shall be read and recorded at the beginning and end of each day.
Point of Sale System. Borrower shall establish and maintain a point-of-sale cash register computer system ("POS System") on terms and conditions reasonably acceptable to Agents in a minimum amount of $5,000,000. Such POS System shall be 75% completed on or before September 15, 1999, and Borrower shall have provided Agent with satisfactory evidence of such implementation as Agent may reasonably request from time to time.
Point of Sale System. In addition to the equipment set forth in Section 5.2 above, Lessor shall install a point-of-sale system at Leased Premises for use by Lessee in connection with its operation of the Leased Premises.
Point of Sale System. Throughout the Term, Contractor shall be responsible for providing and maintaining Client-approved electronic points of sale for all food or drink sold on the Premises. Initially, Client shall provide Contractor access to the POS System on the Premises and shall be responsible for all software and hardware maintenance expense for the POS System beginning on the first day of the Term. In addition, in order to support the POS System and any future point of sale system, Contractor shall, throughout the Term, procure and maintain a Client-approved point of sale server remotely hosted offsite independent of the Client’s IT infrastructure. Client may, during the term of this Agreement and in its sole and exclusive discretion, purchase an updated point of sale system, which Contractor shall utilize upon integration. Should Client elect to upgrade on or before the fifth (5th) anniversary of this Agreement, Contractor shall pay to Client an amount equal to one-million dollars ($1,000,000) or one-half of the equipment cost of the upgraded point of sale system, whichever is greater.
Point of Sale System. To the extent that any of the Restaurants use the HSI-based Point of Sale System (the "POS System") as of the Effective Time, for a period of six months after the date of Closing, Seller will cause AII to provide POS System software upgrades, including Year 2000 compliance upgrades, as such upgrades are supplied in the normal course to AII franchisees and AII company-owned restaurants. For a period of six months after the date of Closing, AII will provide Buyer standard help desk technical support for the POS System. Seller is not obligated to provide any additional POS System software releases or any feature enhancements, or provide any further support (such as back office, food cost or menu maintenance) of the POS System, nor is Seller required to provide any support of any system other than the POS System. Neither Seller nor AII is required to conform or customize to the specific operations of the Restaurants any POS System upgrades or help desk technical support provided to Buyer. Seller is giving no warranty of any kind to Buyer as to the POS System.

Licensee, at its cost, will purchase, install, maintain, and replace as necessary all hardware, software, and accessories (including the installation of any necessary communication or networking changes) that are necessary to implement and maintain the POS devices.

Point of Sale System. Seller shall permit Purchaser to use the point-of-sale system used in the Business for not less than sixty (60) days after the Third Closing Date. Seller shall procure any necessary third-party consents necessary to grant Purchaser such rights of use. Purchaser shall be permitted to use such system in order to access to historical transaction records and support ongoing transactions.
