Common use of Position Classified Upward Clause in Contracts

Position Classified Upward. An incumbent Employee appointed to a new classification with a higher rate of pay, shall be paid as if the Employee were promoted to the positions per Article 12.08 - Rate of Pay on Promotion. If, in accordance with Article 10.02 - Filling a Revised Classification When Encumbered, an Employee with more seniority successfully challenges a reclassified position, and the incumbent Employee is returned to a position in the former classification, such Employee shall be placed at the step in the scale being paid before the reclassification, subject to any increments the Employee would have received had the Employee remained in that position.
