Postdated Items. You agree that when you write a check, you will not date the check in the future. If you do and the check is presented for payment before the date of the check, we may pay it or return it unpaid. You agree that if we pay the check, the check will be posted to your Account on the date we pay the check, even though the posting date is prior to the date of the check. You further agree that we are not responsible for any loss to you in doing so. We will not honor a postdated check if we receive advance notice from you at such a time and in such a manner as to afford us reasonable opportunity to act. The notice must be in writing, and it must specify the date, amount, and number of the check, along with the name of the payee. Notices are effective for the time periods stated under “Stop Payment Orders”. You agree that we may return a postdated check to the presenter. (F)

We will have no liability by reason of our payment of an item prior to the date reflected on the item unless you have given us reasonable advance written notice before the item is presented to us for payment and you follow the procedures for and pay the service fees associated with a stop payment order. Your notice to us must specify the payee, date, amount and item number, and the fact that you have postdated it. Notices with respect to postdated items are not effective for time periods longer than are provided for stop payment orders, and you must notify us before the expiration of that period and pay the applicable service fees if you want the order to be effective beyond the scheduled expiration date. You agree that we may return a postdated item to the presenter before the date shown on the item without liability for wrongful dishonor.

The Bank is authorized to pay any check prior to the date on the item even if you have given us notice that it is postdated. If the Bank agrees to re-credit your account after paying a postdated check you agree to transfer to the Bank all of your rights against the payee or other holder of the check, and to assist in any legal action taken against that party.

Postdated Items. Each Authorized Signatory agrees not to issue postdated checks or other items. If postdated checks or other items are issued by any Authorized Signatory, Bank may return them unpaid, or if paid by Bank, prior to date of check or item, in its sole and absolute discretion, Bank is released from and indemnified for, and held harmless from, any and all claims, damages and/or costs, including its reasonable attorney’s fees and costs, related to paying, accepting or certifying such postdated checks and/or other items prior to the date set forth on said check(s) and/or other item(s) unless Authorized Signatory has given notice to the Bank of the postdated item by describing the check with reasonable certainty.
Postdated Items. The Bank may accept or pay a postdated Item drawn on your Account and received by the Bank on a date which is prior to the date of the Item or contrary to special instructions identified on the Item, unless the Bank receives notice and agrees in writing to be bound by such date or special instructions. Such notice must provide the same information and be provided in the same time frame as stop payment orders. The notice will be effective for the same time periods as for stop payment orders. If the Bank re-credits your Account after paying a postdated Item over a valid and timely notice, you agree to transfer to the Bank all of your rights against the payee or other holder of the Item, and to assist the Bank in legal action taken against that person. Account Fees The Bank may collect fees and charges on your Account in accordance with our Fee Schedule for Personal Accounts and other terms of your Account Agreement. Fees and charges may be deducted from your Account during a statement period other than the one in which it was incurred. You will not hold us Accountable for refusing to pay Checks because of insufficient funds as a result of these fees and charges. In addition to Checking, Money Market, Savings, and Certificate of Deposit Accounts, we may offer other services – such as treasurer’s Checks and savings bond redemption. Separate fees and agreements may apply to each of these services. We may change these fees at any time without notice unless otherwise required by law. We may list some of these fees in our Fee Schedule for Personal Accounts. Box 1602, South Bend, IN 46634. The Check 21 Act Check 21 is a law enacted to simplify the way Checks are processed in the United States. This law created a document called a “substitute Check” which legally replaces the original paper Check.

An item is considered postdated if it is dated after the date it is presented for payment. Unless otherwise required by law, the Bank will not be liable for any damages caused by premature payment of a postdated item or for any damages resulting from dishonor of a postdated item presented for payment before the date of the item.
